11/09/2020 <br />RESOLUTION NO. 15906 <br />A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF REDWOOD <br />CITY APPROVING THE DONATION AGREEMENT FOR THE 9 <br />PARCELS BETWEEN MEL AND MARGUERITE CASEY, TRUSTEES <br />OF THE CASEY FAMILY TRUST, AND THE CITY OF REDWOOD CITY <br />FOR OPEN SPACE PURPOSES AND AUTHORIZING THE CITY <br />MANAGER TO EXECUTE ALL NECESSARY DOCUMENTS TO <br />EFFECTUATE THE ACQUISITION <br />WHEREAS, the Government Code of the State of California Section 37354 <br />authorizes the City Council of Redwood City to accept any gift made to the City for any <br />public purpose; and <br />WHEREAS, Mel and Marguerite Casey, Trustees of the Casey Family Trust, <br />desire to donate to the City of Redwood City 9 parcels of land ("Property") located <br />alongside Canyon Lane near Garrett Park in Redwood City; and <br />WHEREAS, the City's population is growing, and it is very difficult to acquire <br />land; and <br />WHEREAS, the acquisition of the Property as additional open space would <br />benefit the community at large; and <br />WHEREAS, a Donation Agreement between Mel and Marguerite Casey, <br />Trustees of the Casey Family Trust, and the City has been prepared (the "Donation <br />Agreement"), executed by Mel and Marguerite Casey, and submitted to the City <br />Council; and <br />WHEREAS, the City Council is willing to accept the Property pursuant to the <br />terms and conditions set forth in the said Donation Agreement. <br />NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE CITY OF <br />REDWOOD CITY AS FOLLOWS: <br />Section 1. The City Council finds that the above recitals are true and correct. <br />The recitals, together with the Staff Report and the supporting materials, including <br />without limitation the Donation Agreement, the City Charter, the General Plan, Municipal <br />Code, and other applicable City laws and regulations, have together served as an <br />adequate and appropriate evidentiary basis for the findings and actions set forth in this <br />Resolution. <br />Section 2. The City Council finds that the acceptance of the donation of the <br />Property as described in the Donation Agreement is consistent with the objectives, <br />ATTY/RESO.0123/CC RESO DONATION OF CASEY PROPERTY RESO.
