12/21/2020 <br />RESOLUTION NO. 15922 <br />A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF REDWOOD <br />CITY DESIGNATING CITY CONSULTANTS AS AUTHORIZED <br />REPRESENTATIVES TO EXAMINE SALES AND TRANSACTIONS AND <br />USE TAX RECORDS <br />WHEREAS, pursuant to Ordinance No. 2454, the City of Redwood City ("City") <br />entered into a contract with the California Department of Tax and Fee Administration <br />("CDTFA") to perform all functions incident to the administration and collection of the <br />Transactions and Use Tax Ordinance and the local sales and use taxes; and <br />WHEREAS, the City deems it necessary for authorized representatives of the City <br />to examine confidential sales and transactions and use tax records of the CDTFA <br />pertaining to sales and transactions and use taxes collected by the CDTFA for the City; <br />and <br />WHEREAS, Section 7056 of the California Revenue and Taxation Code sets forth <br />certain requirements and conditions for the disclosure of CDTFA records; and <br />WHEREAS, pursuant to California Revenue and Taxation Code Section 7056, the <br />City, by resolution, may designate any officer, employee, or any other person to examine <br />all of the sales or transactions and use tax records of the CDFTA pertaining to sales or <br />transactions and use taxes collected for the City; and <br />WHEREAS, the City has entered into separate agreements for revenue audit and <br />recovery services with MuniServices, LLC and Hinderliter, de Llamas and Associates, <br />and the City wishes to authorize both MuniServices, LLC and Hinderliter, de Llamas and <br />Associates to examine all of the sales and transactions and use tax records of the CDFTA <br />pertaining to the ascertainment of those sales and transactions and use taxes to be <br />collected for the City. <br />NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY <br />OF REDWOOD CITY AS FOLLOWS: <br />SECTION 1. That the Financial Services Manager or other officer or employee of <br />City designated in writing by the Financial Services Manager to the CDTFA is hereby <br />appointed to represent City with authority to examine all of the sales and transactions and <br />use tax records of the CDTFA pertaining to sales and transactions and use taxes collected <br />for City by the CDTFA pursuant to the contract between City and the CDTFA.
