<br />r'.~ <br /> <br />. <br /> <br />DES.ek 5/29/68 <br />. <br /> <br />.r <br /> <br />REE.OLUT1.0N <br /> <br />N o. <br /> <br />51 ()5 <br /> <br />RESOLUTION CANCELLING AND TERMINATING AGREEMENT BETWEEN <br />DUMBARTON FIRE PROTECTION DISTRICT AND CITY OF REDWOOD <br />CITY FOR FURNISHING FIRE PROTECTION BY CITY WITHIN SAID <br />FIRE PROTECTION DISTRICT <br /> <br />WHEREAS, pursuant to Resolution No. 5381, adopted June 13, <br /> <br />1967, the City of Redwood City (hereinafter called "City") and <br /> <br />Dumbarton Fire Protection District (hereinafter called "District") <br /> <br />entered into an agreement for the furnishing of fire protection <br /> <br />services by the City of Redwood city within the then existing <br /> <br />territorial limits of said District in consideration of payment <br /> <br />of compensation therefor; and <br /> <br />WHEREAS, the City of Redwood City has performed all agree- <br /> <br />ments, conditions, promises and covenants under said agreement <br /> <br />by City to be performed; and <br /> <br />WHEREAS, after demand by City duly made for payment to <br /> <br />City of sums past due and owing and now due and owing under <br /> <br />said agreement, District has failed, refused, and does now fail <br /> <br />and refuse to make payment to City for said sums, and City is <br /> <br />required to resort to its legal remedies for recovery thereof; <br /> <br />and <br /> <br />WHEREAS, City desires to provide sufficient notice to <br /> <br />District, its electors, and the Board of Supervisors of the County <br /> <br />of San Mateo of the action taken herein, in order to allow said <br /> <br />District, electors, and Board sufficient opportunity to provide <br /> <br />for the safety and protection of persons and property within <br /> <br />said District; <br /> <br />NOW, THEREFORE; <br /> <br />BE IT RESOLVED BY THE COUNCIL OF THE CITY OF REDWOOD CITY, <br />AS FOLLOWS: <br /> <br />1.
