REG: yc: 3/13/61 -7 RE SO LUT I ON NO. 3336 RESOLUTION AUTHORIZING EXCEPTION TO CERTAIN PRO- VISIONS OF ORDINANCE NO. 631, BEING THE SUBDIVISION ORDINANCE OF THE CITY OF REDWOOD CITY WHEREAS, the Barbour Construction Company, 1743 Edgewood Road, Redwood City, filed with the Redwood City Planning Commission a tentative map for a seven lot subdivision on February 2, 1961, which map was entitled "Maxwell Tract Tentative Map," dated November, 1960, and prepared by Edwin H. Smith, Civil Engineer (Survey 1796) ; and WHEREAS, pursuant to Section 7 of Ordinance No. 631, the Subdivision Ordinance of the City of Redwood City, the Planning Commission has received and recommended approval of the applica- tion of the Barbour Construction Company for an exception to the provisions of Section 5.13(c) of said Ordinance No. 631 to permit the construction of a cul -de -sac street having a length of 369 feet, a length 119 feet in excess of the maximum length permitted by Section 5.13 (c) ; and WHEREAS, the Planning Commission has found and reported to this Council that exceptional circumstances and conditions exist which affect said property; that the exception applied for is necessary for the preservation and enjoyment of substantial prop- erty rights of petitioner; and that the granting of said exception will not be detrimental to the public welfare or adversely affect other property in the neighborhood; and WHEREAS, as a condition to the above findings, the Planning Commission found that it would be necessary for the applicant to meet the following condition: (a) All laws, codes, regulations, resolutions, ordinances and /or parts thereof, other than as directly and ex- pressly adjusted by the terms of the exception granted, shall be strictly complied with.
