REG: yc: 3/13/61 -7 <br />RE SO LUT I ON NO. 3336 <br />RESOLUTION AUTHORIZING EXCEPTION TO CERTAIN PRO- <br />VISIONS OF ORDINANCE NO. 631, BEING THE SUBDIVISION <br />ORDINANCE OF THE CITY OF REDWOOD CITY <br />WHEREAS, the Barbour Construction Company, 1743 Edgewood Road, <br />Redwood City, filed with the Redwood City Planning Commission a <br />tentative map for a seven lot subdivision on February 2, 1961, <br />which map was entitled "Maxwell Tract Tentative Map," dated <br />November, 1960, and prepared by Edwin H. Smith, Civil Engineer <br />(Survey 1796) ; and <br />WHEREAS, pursuant to Section 7 of Ordinance No. 631, the <br />Subdivision Ordinance of the City of Redwood City, the Planning <br />Commission has received and recommended approval of the applica- <br />tion of the Barbour Construction Company for an exception to the <br />provisions of Section 5.13(c) of said Ordinance No. 631 to permit <br />the construction of a cul -de -sac street having a length of 369 <br />feet, a length 119 feet in excess of the maximum length permitted <br />by Section 5.13 (c) ; and <br />WHEREAS, the Planning Commission has found and reported to <br />this Council that exceptional circumstances and conditions exist <br />which affect said property; that the exception applied for is <br />necessary for the preservation and enjoyment of substantial prop- <br />erty rights of petitioner; and that the granting of said exception <br />will not be detrimental to the public welfare or adversely affect <br />other property in the neighborhood; and <br />WHEREAS, as a condition to the above findings, the Planning <br />Commission found that it would be necessary for the applicant to <br />meet the following condition: <br />(a) All laws, codes, regulations, resolutions, ordinances <br />and /or parts thereof, other than as directly and ex- <br />pressly adjusted by the terms of the exception granted, <br />shall be strictly complied with. <br />
