AGREEMENT
<br /> FOR
<br /> IMPROVEMENT OF KENTFIELD PACIFIC PLACE
<br /> THIS AGREEMENT, made and entered into this� day of h�J'N ,
<br /> 2011, by and between the CITY OF REDWOOD CITV', a charter city and municipal
<br /> corporation of the State of California ("City"), and Kentfield Pacific Place, LLC,
<br /> a California Limited Liability Company ("Owner").
<br /> WITNESSETH:
<br /> WHEREAS, Owner is engaged in subdividing for residential purposes and
<br /> developing certain property under the designation of Final Map of Kentfield Pacific
<br /> Place, situated in the City of Redwood City, County of San Mateo, State of California;
<br /> and
<br /> WHEREAS, the City Engineer has determined that the final map conforms to the
<br /> tentative map for the proposed subdivision; and
<br /> WHEREAS, Owner has requested that the final map be approved prior to the
<br /> construction and completion of the public improvements, including all public utility
<br /> facilities which are a part of, or appurtenant to, the abovementioned subdivision, which
<br /> improvements are to be constructed in accordance with, and as required by, the plans,
<br /> specifications and details hereinafter described;
<br /> NOW, THEREFORE, in order to ensure satisfactory performance by Owner of
<br /> Owner's obligations as required by the Conditions of approval for the tentative map for
<br /> said subdivision and by Chapter 30 of the Code of the City of Redwood City, being the
<br /> subdivision regulations of said City, and in consideration of the approval of the final map
<br /> (including the dedication of easements contained therein) for the subdivision, and in
<br /> accordance with the conditions of approval of the tentative map for the subdivision, the
<br /> parties hereto agree as follows:
<br /> 1. IMPROVEMENTS. Owner shall, at Owner's own cost and expense, -
<br /> furnish, construct, install, complete and guarantee all of the improvements
<br /> ("Improvements'), furnish all the materials, and do all the work hereinafter described, in
<br /> accordance with, and as provided for in the plans prepared for Owner by MacLeod &
<br /> Associates, Inc., Consulting Engineers and Surveyors, Sheets C-1 through C-7 dated
<br /> August 15, 2011, and in accordance with City's Specifications entitled, "Engineering
<br /> Standards for the City of Redwood City", adopted December 4, 2006, which plans and
<br /> specifications are on file in the offce of the City Engineer. Said Improvements shall
<br /> also be constructed in strict compliance with the provisions of Chapter 30 of the Code of
<br /> the City of Redwood City, the subdivision regulations of City. To the extent that a
<br /> conflict exists between the plans and specifications and said Chapter 30 in regard to the
<br /> standard for a particular improvement, the stricter standard shall govern. Owner shall
<br /> complete all of the Improvements, subject to time extensions allowable under
<br /> ATTY/AGR/2011.134/KENTFIELD SUBDIVISION
