FXS:dmp 2'~2/95 (047/38) <br /> <br /> --0 R I G I N A n 2/~/95 <br /> <br /> RESOLUTION NO. 12414 <br /> <br /> RESOLUTION APPROVING AND AUTHORIZING EXECUTION OF <br /> AGREEMENT GRANTING AUTHORIZATION FOR THE CONSTRUCTION, <br /> INSTALLATION, MAINTENANCE AND REPAIR OF FIBER OPTIC <br /> CABLES AND RELATED FACILITIES WITHIN THE PUBLIC <br /> RIGHT-OF-WAY <br /> <br /> (METROPOLITAN FIBER SYSTEMS OF CALIFORNIA, INC.) <br /> <br /> WHEREAS, Metropolitan Fiber Systems of California, Inc. <br />wishes to construct, install, and maintain fiber optic cables and <br />related facilities within the public right-of-way, public utility <br />easements, and public service easements within the limits of the <br />City of Redwood City; and <br /> <br /> WHEREAS, under California law, the City of Redwood City may <br />regulate the location and the manner of construction, <br />installation, and maintenance of fiber optic cables and related <br />facilities in the public right-of-way, public utility easements, <br />and public service easements within the limits of the City of <br />Redwood City; and <br /> <br /> WHEREAS, the City of Redwood City wishes to regulate the <br />construction, installation, and maintenance and repair of fiber <br />optic cables and related facilities proposed by competitive <br />access providers and other telecon%munications companies, <br />including Metropolitan Fiber Systems of California, Inc., in the <br />public right-of-way, public utility easements, and public service <br /> <br />easements within the limits of the City of Redwood City; <br /> NOW, THEREFORE; <br /> <br /> BE IT RESOLVED BY THE COUNCIL OF THE CITY OF REDWOOD CITY, <br />AS FOLLOWS: <br /> <br /> <br />
