09/10/2012 <br /> ORIGINAL <br /> RESOLUTION NO. 15219 <br /> A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF <br /> REDWOOD CITY APPROVING A VESTING TENTATIVE MAP <br /> PURSUANT TO THE SUBDIVISION MAP ACT AND THE <br /> REDWOOD CITY MUNICIPAL CODE <br /> WHEREAS, Kirk McGowan dba McGowan Development ("Applicant") <br /> submitted applications to the City of Redwood City ("City") for (i) a Planned <br /> Development Permit, including Modifications to zoning district regulations, and (ii) <br /> a Vesting Tentative Map including Exceptions to the Subdivision Ordinance (the <br /> "Finger Avenue ProjecY' or "Project"); and <br /> WHEREAS, the Planning Commission of the City of Redwood City <br /> ("Commission") is empowered by Article 46 (Planned Development Permits) to <br /> act upon applications for planned development permits; the Commission is also <br /> empowered by the Subdivision Map Act and the Redwood City Municipal Code to <br /> consider Vesting Tentative Map Applications; and <br /> WHEREAS, pursuant to a Settlement Agreement dated July 26, 2010 by <br /> and among Applicant, City, and the Friends of Cordilleras Creek and Finger <br /> Avenue Pride Committee ("Friends"), among other things, the City agreed to <br /> prepare and certify an Environmental Impact Report for the Project pursuant to <br /> California Environmental Quality Act ("CEQA") before it may approve the Project. <br /> The City also agreed that the Project and Environmental Impact Report would be <br /> considered by both the City's Planning Commission and City Council; and <br /> WHEREAS, on June 19, 2012, the Planning Commission held a duly <br /> noticed public hearing on the Finger Avenue Project, including the Final <br /> Environmental Impact Report for the Finger Avenue Nine-Lot Planned <br /> Development Project ("Final EIR"), and recommended that the City Council (1) <br /> certify the EIR, adopt the necessary CEQA Findings, and adopt a Mitigation <br /> Monitoring and Reporting Plan in accordance with CEQA, by Resolution No. 12- <br /> 16; and (2) strongly consider approval of the alternative identified in the Final EIR <br /> as the "Project with 25 Foot Creek Setback Alternative" without (a) increasing <br /> home sizes elsewhere in Lots 1-4, (b) reducing front yard setbacks or driveway <br /> aprons, or (c) removing heritage trees other than those (10 trees) already <br /> proposed for removal by the Project applicant, by Resolution No. 12-19; and <br /> WHEREAS, the "Project with 25 Foot Creek Setback Alternative" is similar <br /> to the Project as proposed by the developer except that the residences on Lots <br /> 1-4 would be setback 25 feet from the top of creek bank and reduced in size by <br /> 187 square feet for Lot 1, 348 square feet for Lot 2, 95 square feet for Lot 3 and <br /> 87 square feet for Lot 4 (for a total building reduction of 720 square feet).
