Developer is the current fee owner of that certain real properiy consisting of <br /> approximately 6.69 acres located within the City of Redwood City, County of San Mateo, State of <br /> California, described in Exhibit A, attached hereto and incorporated herein by reference (the"Property"). <br /> B. On October 30, 2012, the Planning Commission of the City of Redwood City adopted, <br /> among other approvals, Resolution No. 12-24, approving the Vesting Tentative Map for the One Marina <br /> ("Project"), prepared by KPFF Consulting Engineers and dated August 22, 2012 ("Tentative Map"), <br /> subject to certain conditions of approval("Conditions"). <br /> C. The Conditions require either (1) that certain public improvements for the Project be <br /> constructed prior to approval of the final map ("Final Map"), or (2) that Developer enter into an <br /> agreement with City providing for the future construction of such public improvements. <br /> D. Developer has submitted the Final Map and applied to City for Final Map approval <br /> without having completed the required public improvements and, therefore, will enter into an agreement <br /> with City providing for the future construction and installation of such public improvements, as required <br /> by Government Code section 66462(a)(1). <br /> E. Developer has submitted to City plans, specifications and drawings entitled One Marina <br /> Phase 2 and One Marina Phase 3 Improvement Plans,prepared by KPFF Consulting Engineers, Callander <br /> Associates, and Lighthouse Design, Inc. and dated November 28, 2012 (Phase 3) and July 25, <br /> 2012 <br /> (Phase 2) ( (the"Improvement Plans"), which, in addition to other improvements, provide for certain on- <br /> site public improvements consisting of street and street light improvements, storm drain systems, <br /> domestic water systems and sanitary sewer systems for the Project(collectively,"Improvements"). <br /> F.
