05/06/2013 <br /> ORIGINAL <br /> RESOLUTION NO. 15262 <br /> A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF <br /> REDWOOD CITY SETTING ASIDE THE PLANNING <br /> COMMISSION ACTION OF OCTOBER 30, 2012 FOR THE <br /> PETE'S HARBOR PROJECT; REMANDING THE <br /> APPLICATION TO THE PLANNING COMMISSION FOR <br /> ACTION ON THE REVISED PETE'S HARBOR PROJECT; AND <br /> DENYING THE APPEAL OF THE PLANNING COMMISSION <br /> ACTION AS MOOT <br /> WHEREAS, Applicant, RWC Harbor Communities, LLC, seeks to <br /> develop 411 residential units and re-subdivide Lots APN 052-540-040 and APN <br /> 052-540-050 located at 1 Uccelli Boulevard, commonly known as Pete's <br /> Harbor, and applied for a Planned Development Permit and Vesting Tentative <br /> Map (the Project); and <br /> WHEREAS, the Planning Commission of the City of Redwood City <br /> (Commission) is empowered to act upon applications for Planned Development <br /> Permits in accordance with Article 46 (Planned Development Permits) of the <br /> City of Redwood City Zoning Ordinance when the Commission is also the <br /> determining body for an environmental review document associated with the <br /> same Project; and <br /> WHEREAS, on October 16, 2012 and October 30, 2012, the Planning <br /> Commission of the City of Redwood City (Commission) held a duly noticed <br /> public hearing in accordance with all applicable requirements of the State <br /> Planning and Zoning law, considered the environmental review associated <br /> with the Project in accordance with the requirements of the California <br /> Environmental Quality Act (CEQA); and <br /> WHEREAS, the Commission adopted Resolution No. 12-23 considering <br /> the 2003 Marina's Shores Village Environmental Impact Report (EIR), <br /> Addendum No. 1 to the EIR and Addendum No. 2 to the EIR and approving <br /> the Project, including the Planned Development Permit and the Vesting <br /> Tentative Map; and <br /> WHEREAS, Alison Madden for and on behalf of Save Pete's Harbor <br /> 2012 appealed the Commission's approval of the Project and adoption of <br /> Resolution No. 12-23 to the City Council; and <br /> WHEREAS, the matter was duly noticed for a de novo public hearing <br /> before the City Council on January 28, 2013; and <br /> Page 1 of 2 <br /> ATTY/RE50.2849/PETE'S HARBOR RESO.#15262 <br /> REV:04-30-13 VR MUFF#603 <br />
