<br /> DES:yc:6/l6/78 <br /> ORIGINAL <br /> ORDINANCE NO. 1755 <br /> JUN 26 1978 <br /> --------- - - <br /> ORDINANCE AMENDING SECTION 32.75 OF THE REDWOOD CITY CODE <br /> RELATING TO THE RATE OF TAX IMPOSED UPON THE PRIVILEGE OF <br /> HOTEL OCCUPANCY, AND DECLARING THE ENACTMENT HEREOF TO BE <br /> NECESSARY AS AN EMERGENCY MEASURE <br /> THE COUNCIL OF REDWOOD CITY DOES ORDAIN AS FOLLOWS: <br /> SECTION 1. Section 32.75 of the Redwood City Code is hereby <br />amended to read as follows: <br /> "Section 32.75 For the privilege of occupancy in any <br /> hotel, each transient is subject to and shall pay a tax in the <br /> amount of eight percent (8%) of the rent charged by the operator. <br /> Said tax constitutes a debt owed by the transient to the City <br /> which is extinguished only by payment to the operator or to the <br /> City. The transient shall pay the tax to the operator of the <br /> hotel at the time the rent is paid. If the rent is paid in <br /> installments, a proportionate share of the tax shall be paid <br /> with each installment. The unpaid tax shall be due upon the <br /> transient's ceasing to occupy space in the hotel. If for any <br /> reason the tax due is not paid to the operator of the hotel, <br /> the tax administrator may require that such tax shall be paid <br /> directly to the tax administrator." <br /> SECTION 2. This ordinance is hereby declared by the Council of <br />Redwood City to be necessary as an emergency measure for the immediate <br />preservation of the public peace, hea'lth and safety in that the <br />increased tax revenues anticipated by enactment hereof are included <br />in the City's Annual Budget for Fiscal Year July 1, 1978-June 30, <br />1979, as a partial off-set for the anticipated reduction in ad valorem <br />real property tax revenues pursuant to Article XIII A of the Constitution <br />of the State of California, added by initiative amendment, the pertinent <br />provisions of which become operative July 1, 1978. The proceeds of <br />the tax which is the subject of this ordinance are used for the usual <br /> 1 755 <br /> "T'-'. <br />
