<br />- - <br /> ORIGINAL <br />AGREEMENT REGARDING DISTRIBUTION AND USE OF ~~ <br />1995-96 AB 434 FUNDS <br />~" .. \C,c\ '\ <br />This Agreement is made this 9=- day of Y0-~L'-''ì<;' +995-, by and between the <br />City/County Association of Governments of San Mateo County, hereinafter referred to as <br />"C/CAG" and the City of Redwood City, hereinafter referred to as "CITY". <br />WITNES.S.ETH <br />RECIT ALS <br />WHEREAS, on October 10, 1991, the State of California enacted Assembly Bill (AB) <br />434, authorizing the Bay Area Air Quality Management District (hereinafter referred to as <br />"BAAQMD") to impose a fee on motor vehicles to be used for specified transportation control <br />projects and programs that are included in the BAAQMD's 1991 Clean Air Plan (CAP), as <br />developed and adopted pursuant to the requirements of the 1988 Califomia Cle.a.n Air Act; and <br />WHEREAS, the BAAQMD's objectives for administration of these funds are to: <br />(1) fund transportation programs and projects that most effectively achieve emissions reductions <br />from motor vehicles, (2) administer AB 434 funding as efficiently as possible, and (3) maintain <br />accountability of the expenditure of AB 434 funds; and <br />WHEREAS, AB 434 specifies certain transportation control projects and programs in the <br />'91 CAP that are eligible for funding; and <br />WHEREAS, AB 434 provides that not less than forty percent (40%) of the fee revenues <br />generated in each county within the BAAQMD shall be allocated for programs in that county to <br />an entity designated as the overall Program Manager by the County Board of Supervisors and city <br />councils for a majority of the cities representing a majority of the population in the incorporated <br />area of the County; and <br />...... .- <br />
