<br />AGREEMENT <br /> <br />FOR <br /> <br />ORIGINAL <br /> <br />UNDERGROUNDING EXISTING OVERHEAD FACILITIES (PG&E, PACBELL, CABLE <br />TV) CONSTRUCTION AT 890 BROADWAY <br /> <br />THIS AGREEMENT, made and entered into this ~Or:.- day of (Q( Jo,J-f>- . <br />2000, by and between the CITY OF REDWOOD CITY, a municipal corporation of the <br /> <br />State of California, ("City"), and 890 BROADWAY ASSOCIATES, L.L.C., a California <br /> <br />limited liability company, ("Owner") the owner of record of said real property located at <br /> <br />890 Broadway, Redwood City, California (the "Property"); <br /> <br />WITNESSETH: <br /> <br />WHEREAS, Owner proposes to construct certain real property improvements of <br /> <br />the Property, situated in the City of Redwood City, County of San Mateo, State of <br /> <br />California, consisting of the remodeling of the existing building and other associated <br /> <br />improvements; and <br /> <br />WHEREAS, Owner has requested that certain Improvements (as defined below), <br /> <br />be constructed at the Property in accordance with, and as required by, the plans, <br /> <br />specifications, and details hereinafter described are to be prepared by Pacific Gas and <br /> <br />Electric Company; title to which improvements shall be conveyed to the appropriate <br /> <br />utility company; and <br /> <br />NOW, THEREFORE, in order to ensure satisfactory performance by Owner of <br /> <br />Owner's obligations under Article VII, Chapter 29, General Street Improvements, of the <br /> <br />Code of the City of Redwood City, and in consideration of the approval of the <br /> <br />improvements for the Property, the parties hereto agree as follows: <br /> <br />1. Improvements.
