<br />DES:yc:l/28/80 <br />6/26/80 R <br />8/15/80 R <br /> <br />--------- <br /> <br />DUPLICATE <br />ORiGiNAL <br /> <br />A G R E E MEN T <br /> <br />WASTEWATER TREATMENT CAPACITY <br /> <br />(Emerald Lake Hills Area) <br /> <br />THIS AGREEMENT, made and entered into this <br /> <br />~ <br /> <br />/ (;1 day of <br />/ I <br /> <br />j, . 1 I" --J <br />,~<,./j- "/~~~~- <br /> <br />, 1980, by and between the CITY OF REDWOOD CITY, <br /> <br />a municipal corporation of the State of California ("City"), and <br /> <br />the COUNTY OF SAN MATEO, a political subdivision of the State of <br /> <br />California ("County"); <br /> <br />WIT N E SSE T H : <br /> <br />WHEREAS, the Emerald Lake Hills Area (hereinafter defined) <br /> <br />comprises a portion of the unincorporated territory of County in the <br /> <br />vicinity of City's boundaries; and <br /> <br />WHEREAS, portions of said Emerald Lake Hills Area are within <br /> <br />existing sewer maintenance districts established by County pursuant <br /> <br />to the laws of the State of California, and the remaining and larger <br /> <br />portion of said Area is not within such m~intenance districts; and <br /> <br />WHEREAS, the Emerald Lake Hills Area is within the sanitary <br /> <br />sewerage service area of City; and <br /> <br />WHEREAS, City is a party to that certain joint exercise of <br /> <br />powers agreement (hereinafter described), establishing the South <br /> <br />Bayside System Authority, a public entity (hereinafter defined) which <br /> <br />currently provides sanitary sewerage transmission and disposal <br /> <br />services to City and other constituent agencies of said Authority; <br /> <br />and <br /> <br />WHEREAS, said Authority has cormnenced construction of, and <br /> <br />proposes to operate and maintain, new sanitary sewerage treat~ent <br /> <br />facilities in conjunction with its present transmission and disposal <br /> <br />facilities to serve its service area which includes the lands within <br /> <br />the Emerald Lake Hills Area; and <br />
