<br />01/25/2010 <br /> <br />ORIGINAL <br /> <br />ORDINANCE NO. 2352 <br /> <br />AN INTERIM ORDINANCE OF THE CITY OF REDWOOD CITY <br />EXTENDING A TEMPORARY MORATORIUM ON THE <br />ESTABLISHMENT AND OPERATION OF MEDICAL MARIJUANA <br />COLLECTIVES <br /> <br />WHEREAS, the voters of the State of California approved Proposition 215 <br />(codified as Health and Safety Code section 11362.5 et seq. and entitled the <br />"Compassionate Use Act of 1996") legalizing the use of marijuana for specific <br />medical purposes; and <br />WHEREAS, in 2003, the Medical Marijuana Program Act (MMP) (Health <br />and Safety Code section 11362.7 et seq.) was adopted, which clarified the scope <br />of the Compassionate Use Act and allowed cities and other governing bodies to <br />adopt and enforce rules consistent with the MMP and the Act; and <br />WHEREAS, the City's General Plan, Zoning Ordinance and Municipal <br />Code do not specifically address the regulation or location of medical marijuana <br />collectives (or "dispensaries") as a permitted or conditionally permitted use in any <br />zoning district; and <br />WHEREAS, the City has received inquires from prospective medical <br />marijuana collective operators regarding the City's policy with respect to medical <br />marijuana collectives; and <br />WHEREAS, California cities that have permitted the establishment of <br />medical marijuana collectives have observed adverse impacts on public health, <br />safety and welfare, including an increase in crimes such as burglaries, robberies, <br />or sale of illegal drugs at the collectives and in areas immediately surrounding the <br />collectives; and <br />WHEREAS, there are several open state law questions regarding the <br />regulation of medical marijuana collectives; and <br /> <br />Atty/Ord/Ord .328 <br />011410 <br /> <br />2352 <br />FORMERLY MUFF # 205 <br />
