<br /> I ~----- <br /> ORIGINAL -:!flu <br /> REVOCABLE liCENSE AGREEMENT <br /> (Main Street / Bradford Street Rear Lot) <br /> This License Agreement ("License"), effective as of March 1, 2004, is made by and <br /> between the City of Redwood City ('City"), and Associated Press ("Licensee"). <br /> RECITALS <br /> ,^.. City has constructed a parKing lot at the intersection of Bradford Street and Main Street <br /> (the "Property") to provide temporary parking during the period of a major trial. <br /> B. Licensee is in need of temporary parking spaces on the Property for a limited period of <br /> time and is desirous of using a portion of the Property for parking purposes. <br /> C. City has made improvements to the Property for it to serve as a temporery reeking lot <br /> and is wiiiing to alloN licensee to use the Property for temporary parKing purposes. <br /> NOW, THEREFORE, IT IS AGREED AS FOLLOWS: <br /> 1. Scope of license. City hereby grants a non-exclusive license to licensee to enter upon <br /> the Property for the purpose of parking one (1) vehicle as further described in the attached Exhibit "A" <br /> (the "Vehicle"). Use of the Property in this manner shall commence on /\At; rei", I ,2004 on a <br /> month-to-month basis, terminable pursuant to Paragraphs 2 and 13 of this license. <br /> 2. Temoorary license. This license Is temporary in nature and does not constitute a deed, <br /> grant, of easement or lease, or other conveyance of any right, title, or interest in or to the Property. <br /> Notwithstanding Paragraph 13 of this License, the City or Licensee, respectively, as terminating party <br /> may terminate this License at any time during which it is in effect by giving notice thereof to the non- <br /> terminating party not less than thirty (30) days prior to the effective date of terminatic". <br /> 3. . MonthlY Payment. For the abiiity to park the Vehicle on the Property, Licensee shall pay <br /> the City a fee of One Hundred Ten Dollars ($110) per month, in advance on or before the first day of each <br /> month while this License remains in effect, fbr each 3D-day period of occupancy hereunder commencing <br /> upon the effective date of this License. In the event that the effective date of termination is on any day <br /> other than the last day of a monthly period for which the License fee hereunder is payable, such fee shall <br /> be prorated on a daily basis to such date of termination. This fee is based on the cost associated with the <br /> establishment and maintenance of the Property for media use and may be reduced by the City at the <br /> beginning of anyone (1) month period. <br /> 4. Condition of Premise~. Licensee shall keep its portion of the Property clean, neat, <br /> orderly and free of papers, debris, or other wastes. <br /> 5. ç::il,!}.ç::.~.f::.. cr', fi'S,,>VJS Ii'] right to access the Property or any part thereof for any <br /> purpose in furtherance of City's use of the Property. Notwithstanding tile foregoing, City shall extend <br /> reasonable efforts not to interfere with Licensee's use and occupancy of the Property in exercising its <br /> rights under this paragraph. <br /> 6. Holdover. If, upon expiration or revocation of this License, Licensee remains on the <br /> Property, City may remove the Vehicies without written notice to Licensee. <br /> 7. Waiver of Claims. City assumes no responsibility for the guarding or safekeeping of <br /> Licensee, the Vehicle or Licensee's personal property. Except for damage or injuries caused by City, its <br /> agents, officers or employees, Licensee waives all claims egainst City its agents, officers or employees <br /> for any damages to Licensee, the Vehicle or Licensee's personal property and for injuries to any <br /> employees of Licensee or their agents in or about the Property. <br /> 8.
