DAS:d" 03/23/89 (004/39) <br /> <br /> OR!GINAL <br /> AGREEMENT <br /> <br /> HEALTH RISK ASSESSMENT SERVICES FOR <br /> WESTPORT PROJECT SITE, REDWOOD CITY, CALIFORNIA <br /> THIS AGREEMENT, made this . /./ ~day of ~l~ , <br /> <br /> /! <br /> 1989, by and between the CITY OF REDWOOD CITY, a~ municipal <br /> <br />corporation of the State of California, ("City") and CHEM RISK, A <br />McLAREN COMPANY ( "consultant "); <br /> <br /> WI TN E S SETH : <br /> <br /> WHEREAS, City desires to engage a consultant to perform <br />certain professional services, including, but not limited to <br />health risk assessment services; and <br /> <br /> WHEREAS, Consultant represents that it is qualified to <br />furnish such services in accordance with the terms and conditions <br />hereinafter set forth; <br /> <br /> NOW, THEREFORE, the parties hereto agree as follows: <br /> <br /> 1. CONSULTANT'S SERVICES. Consultant shall furnish those <br />services as set forth in Exhibit "A", attached hereto and <br />incorporated herein by reference. <br /> <br /> 2. COMPENSATION. City shall compensate Consultant as <br />provided for in Exhibit "B", attached hereto and incorporated <br />herein by reference, provided however that the total compensation <br />payable hereunder shall not exceed Ninety-five Thousand Four <br />Hundred Thirty and No/100 Dollars ($95,430.00) unless <br />authorization be granted for compensation in excess of said <br />amount by motion duly made and carried by City's City Council. <br /> <br /> 3. RECORDS, STATEMENTS, PAYMENT. Consultant shall keep and <br />maintain accurate records of time devoted to rendering services <br />hereunder.
