Ii <br />_ i\IUii ~t..u... <br /> <br />o R DIN A N C E <br />--------- <br /> <br />NO. /'V .r..s- <br /> <br />/Yj;-ii <br /> <br />TO <br /> <br />ORDINANCE AMENDING CHAPTER 11, ARTICLE IV OF THE CODE <br />OF THE CITY OF REDWOOD CITY BY ADDING THERETO DIVISION <br />5 TO AUTHORIZE CONVERSION OF OVERHEAD ELECTRICAL OR <br />COMMUNICATION FACILITIES TO UNDERGROUND LOCATIONS BY <br />SPECIAL ASSESSMENT PROCEEDINGS <br /> <br />THE COUNCIL OF REDWOOD CITY DOES ORDAIN AS FOLLOWS: <br /> <br />SECTION 1. Chapter 11, Article IV of the Code of the <br /> <br />City of Redwood City is hereby amended by adding thereto <br /> <br />"Division 5. Special Assessment Proceedings", consisting of <br /> <br />Sections 11.66 through 11.68, inclusive, to read as follows: <br /> <br />"DIVISION 5. SPECIAL ASSESSMENT PROCEEDINGS <br /> <br />"Section 11. 66. When in the opinion of the City <br /> <br />Council the public interest and necessity requires the <br /> <br />conversion of existing overhead electrical or comrnuni- <br /> <br />cation facilities and appurtenances to underground <br /> <br />locations, it is hereby authorized and empowered to <br /> <br />order and cause the work of such conversion to be <br /> <br />accomplished within any public street, easement, right <br /> <br />of way or other public place, by means of special <br /> <br />assessment proceedings, either alone or in conjunction <br /> <br />with the accomplishment of other public works. The <br /> <br />City Council hereby finds and determines that such <br /> <br />conversion is a municipal affair and constitutes a work <br /> <br />of improvement to such public streets, easements, rights <br /> <br />of way or other public places. <br /> <br />"Section 11.67. proceedings for the accomplishment <br /> <br />of such conversion and the assessment of costs thereof <br /> <br />upon the properties benefited thereby may be undertaken <br /> <br />by the Council pursuant to any general law or City <br /> <br />ordinance assessment procedure, or a combination of such <br />
