ATTY/RESO.0021/CC RESO ADOPTING RELOCATION ASSISTANCE ADMINISTRATIVE FEES <br />REV: 05-05-26 LF <br />Page 1 of 6 <br />RESOLUTION NO. 16404 <br />A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF REDWOOD <br />CITY ADOPTING RELOCATION ASSISTANCE ADMINISTRATIVE FEES <br />AND A FAIR RATE OF RETURN APPEAL FEE FOR THE HOUSING <br />DIVISION <br />WHEREAS, the City has the authority to impose fees and charges to offset the <br />costs for municipal services and regulatory programs; and <br />WHEREAS, on July 23, 2018, the City Council adopted Chapter 42 (Relocation <br />Assistance) and Chapter 42A (Minimum Lease Terms) of the City Code, requiring <br />landlords to provide relocation assistance to certain low-income tenants who are <br />displaced and offering minimum lease terms to all tenants; and <br />WHEREAS, Section 42.6(F) of Chapter 42 (Relocation Assistance) authorized the <br />Relocation Assistance Administrative Fee to recover costs associated with providing <br />relocation assistance services and the City Council set the fee amount by Resolution No. <br />15919, adopted on November 23, 2020; and <br />WHEREAS, on November 10, 2025, the City Council repealed and replaced <br />Chapter 42 (Relocation Assistance) and Chapter 42A (Minimum Lease Term) of the City <br />Code with Chapter 42 (Tenant Protection), that updated the relocation assistance <br />requirements and created a right to return for tenants in certain circumstances ; and <br />WHEREAS, Section 42.6(C)(5) of the City Code authorizes the City to collect an <br />administrative fee from the landlord to process a tenant’s relocation assistance <br />application in an amount set by resolution of the City Council; and <br />WHEREAS, Section 42.5(B)(2)(d)(iv)(IV) of the City Code authorizes the City to <br />collect an administrative fee from a landlord who chooses to appeal the right to return <br />rent, and provides that the fair rate of return appeal fee will be in an amount set by <br />resolution of the City Council; and <br />WHEREAS, the fully burdened hourly rate shall include the hourly rates for each <br />position attributable to direct costs, divisional overhead, administrative overhead, and <br />city-wide overhead. Initial fully burdened hourly rate were calculated as part of the fee <br />Study conducted by Matrix Consulting Group and adopted by Ordinance No. 2530 on <br />October 23, 2023. Thereafter, such rates have been adjusted annually by applying <br />increase factors as described in Section 4 below to arrive at the fully burdened hourly <br />rates for Fiscal Year 2025-2026. City’s Master Fee Schedule and annual rate adjustments <br />are on file with the Office of the City Clerk; and <br />WHEREAS, City staff determined the reasonable cost to the City of providing the <br />relocation assistance services and the fair rate of return appeal services. The fee <br />calculation is attached hereto as Exhibit A; and
