ORIGINAL <br /> <br /> <br /> ORDINANCE NO. 2118 <br /> <br /> ORDINANCE APPROVING AND AUTHORIZING <br /> EXECUTION OF FRANCHISE AGREEMENT WITH <br /> BROWNING-FERRIS INDUSTRIES OF CALIFORNIA, INC., <br /> FOR GREEN WASTE COLLECTION SERVICES <br /> <br /> WHEREAS, the City of Redwood City is a Member Agency of the South <br />Bayside Transfer Station Authority ("Authority"), a public entity formed by <br />agreement under the California Joint Exercise of Powers Act (Govt. Code §6500, <br />et seq.); and <br /> <br /> WHEREAS, the City has heretofore entered into franchise agreements <br />with Browning-Ferris Industries of California, Inc. (the "Company") to collect and <br />dispose of solid waste and recyclable materials, respectively, which franchise <br />agreements incorporate by reference certain terms and provisions of a Uniform <br />Franchise Agreement developed by Authority; and <br /> <br /> WHEREAS, the Authority has prepared a uniform Green Waste <br />agreement for the collection of "Green Waste" (defined therein to include <br />organic recyclable materials consisting of, among other matters, grass cuttings, <br />weeds, leaves, prunings, branches, and similar materials); and <br /> <br /> WHEREAS, a proposed franchise agreement for the collection of Green <br />Waste, based upon the aforesaid uniform agreement between the City and the <br />Company, has been presented to and reviewed by this Council; and <br /> <br /> WHEREAS, this Council desires to approve and authorize the execution <br />of said Green Waste franchise agreement, as a separate and distinct agreement <br />apart from the aforesaid solid waste and recyclable materials collection and <br /> <br />Ord-009 1 <br />G:/shared/redwood/council <br />DES:rg <br />10/11/96 <br />2118 <br /> <br /> <br />
