ORIGINAL AGREEMENT FOR SHARED FIRE MARSHAL SERVICES THIS AGREEMENT ("Agreement") made and entered into this day of August 9,2010 by and between the BELMONT-SAN CARLOS FIRE DEPARTMENT, a Joint Powers Agreement, ("Fire JPA") and the CITY OF REDWOOD CITY, a municipal corporation of the State of California ("City"). RECITALS: WHEREAS, the City and the Fire JP A provide mandated fire and life safety prevention services, fire investigation, and fire prevention management services; and WHERAS, the City and Fire JP A wish to implement "Shared Fire Marshal" Services in order to provide the most efficient fire marshal services to the City and the Fire JP A. NOW, THERFORE, it is hereby agreed by the parties hereto as follows: 1. Scope of Shared Fire Marshal Services. The Fire JP A shall provide the City an employee of the Fire JP A to a. develop and maintain the City's Fire Prevention related programs as defined below: · Fire and Life Safety Code management services to the Chief of the City Fire Department and City staff · Fire Code, Company Inspection Management · Origin and Cause Fire Investigation procedures · Fire Plan review management · Public Information Officer duties · Department staff training in fire code inspection processes and procedures b. Fire JP A initially delegates its current Fire Marshal, Jim Palisi, to provide Shared Fire Marshal services under this Agreement. c. Chief of the Fire JP A will continue to provide overall supervision of the Shared Fire Marshal. In the event of a conflict between direction given by Fire JP A Chief and City Fire Chief, the Fire JP A Chief and the City Chief will meet and use their best efforts to resolve the conflict. 2. Term of the Agreement. This Agreement shall become effective upon execution by both parties and shall continue in full force and effect until terminated in writing by either party pursuant to Section 10, Termination.
