DES:em 3/11/71 <br /> 4 ORIGINAL <br /> R E S O L U T I O N NO. L3'4‘ OM 15 71 <br /> RESOLUTION CONSENTING TO ASSIGNMENT OF CERTAIN CONTRACT <br /> INTERESTS - L. C. SMITH COMPANY (MARLIN SUBDIVISION <br /> NO. 1 IMPROVEMENTS) <br /> WHEREAS, pursuant to Resolution No. 6037, adopted July <br /> 14, 1969, this Council awarded its contract for construction of <br /> public improvements for Redwood City General Improvement District <br /> No. 1 -64, Marlin Subdivision No. 1, to L. C. SMITH COMPANY, San <br /> Mateo, California, and said contract has been executed by the <br /> parties thereto; and <br /> WHEREAS, said contract provides that the contractor may <br /> assign the contract only upon written consent of the City; and <br /> WHEREAS, written request has been received from Bank of <br /> America, South San Francisco Branch, for acknowledgment of, and <br /> consent to, an assignment of accounts and contract rights to said <br /> bank by said L. C. Smith Company; and <br /> WHEREAS, this Council desires to consent to said requested <br /> assignment; <br /> NOW, THEREFORE, <br /> BE IT RESOLVED BY THE COUNCIL OF THE CITY OF REDWOOD CITY, <br /> AS FOLLOWS: <br /> 1. Pursuant to the provisions of that certain agreement <br /> entitled "Agreement - Redwood City General Improvement District <br /> No. 1 -64, Marlin Subdivision No. 1 Improvements," dated July 29, <br /> 1969, by and between the City of Redwood City and L. C. Smith <br /> Company, consent is hereby granted to said L. C. Smith Company to <br /> an assignment by said company to the Bank of America, South San <br /> Francisco Branch, of certain interests in the aforesaid contract <br /> as more specifically set forth in that certain agreement entitled <br /> "Security Agreement" by and between L. C. Smith Company and the <br /> Bank of America National Trust and Savings Association, dated <br />
