A � RESOLUTION NO. 2001 -02 A RESOLUTI OF THE PLANNING COMM ISSION OF THE CITY OF REDWOOD CITY REPORTING ON AND RECOMMENUNC ADOPTION OF TH.F FIFTH AMENDMENT TO THE REDEVELOPMEN PLAN FOR REDEVELOPMENT PROJECT # 2 Whereas, the Redevelopment Agency .of the City of Redwood City (the "Agency ") has :submitted to the .Planning Commission the Fifth Amendment to the Redevelopment Plan (the "Fifth Amendment ") for Redevelo ment Pro # 2 p � (the "P roject" ); and Whereas, Section 33346 of the , California Community Redevelopment Law (Health and Safety code Section 33000 et 'se .) rovides that the Planning g Commission is to review the proposed Fifth rnendment and males Its report and recommendations thereon to the Agency and the city Council of the Cit y of Redwood city (the "City council "), including a determination wh ther the Fifth Amendment conforms to- the General Plan of the City of Redwood City; and Whereas, Section 65402 of the Government Code provides in part: "(a) If . a general plan or part thereof has been adopted, no real property shall be acquired by dedication or otherwise for street. square, arl or p other public purposes, and no real property shall be disposed of no street Shall be vacated or abandoned, and no public building or structur' shall be .constructed or authorized, if the adopted general plan or art thereof applies p pp thereto, until the location, purpose and extent of such acquisition or disposition, such street vacation or abandonment, or such public building or structure have been submitted to and reported .upon by the planning ag ency as to conformity y with said adopted general plan or part thereof..," ".(c) .A local agency shall not acuir real property for any of the .purposes specified in paragraph ( a) nor dispose of any real roe ,nor p p construct or authorize a public.building or structure, in any county or city, if such county or city has adopted .a general plan or part thereof and such general plan or part thereof is applicable thereto, until the location, purpose and extent of such acquisition, disposition., or such ppublic .building or structure have been submitted to and report upon by the planning agency having Jurisdiction, as to conforms y Frith said adopted general plan or part thereof...
