DES:yc:11/16/78 <br /> OP,MINAL <br /> R E S O L U T I O N N O. 8 1 7 2 NOV 2 0 1978 <br /> RESOLUTION APPROVING AND AUTHORIZING EXECUTION OF <br /> AGREEMENT PROVIDING FOR SANITARY SEWERAGE CAPACITY <br /> RIGHTS (FAIR OAKS SEWER MAINTENANCE DISTRICT) <br /> WHEREAS, the Fair Oaks Sewer Maintenance District is a sewer <br /> maintenance district which owns and operates certain sanitary <br /> sewerage collection and transmission facilities serving lands <br /> within its boundaries; and <br /> WHEREAS, pursuant to an agreement by and between said District <br /> and this City dated July 15, 1947, as amended, the parties thereto <br /> currently provide for the transmission, treatment and disposal of <br /> sewage emanating from said District; and <br /> WHEREAS, this City is a party to that certain joint exercise <br /> of powers agreement establishing the South Bayside System Authority, <br /> a public entity; and <br /> WHEREAS, said Authority proposes to construct, operate and <br /> maintain new sanitary sewerage treatment facilities in conjunction <br /> with its present transmission and disposal facilities to serve its <br /> service area which includes the lands within the Fair Oaks Sewer <br /> Maintenance District; and <br /> WHEREAS, the construction of said new sanitary sewerage treat- <br /> ment facilities is to be funded by Federal and State grants, together <br /> with local public funds, but the capacity of said facilities so <br /> grant-funded to treat sewage is restricted by Federal and State <br /> regulations implementive of the Federal Water Pollution Control Act, <br /> as amended; and <br /> WHEREAS, this City has provided for sanitary sewerage treatment <br /> capacity, the construction of which is partially to be funded by <br /> the aforementioned grants, but no treatment capacity will be available <br /> to treat sewage in excess of said grant eligible capacity unless <br /> funding for the construction of such additional non-grant eligible <br /> capacity is separately provided; and <br /> 8 7 72 <br />
