PUBLIC COMMENT
Laura Baldini announced the upcoming Relay for Life annual event and invited the
Council to attend. She would like the Relay to be bigger than last year and more
community outreach. She has heard about Team Redwood City and she inquired
how balloons and banners could be added to downtown to paint the town purple.
Ms. Baldini shared her thanks for the Council's past support and looks forward to
the event on May 17-18, 2014. Ms. Baldini said that she is a cancer survivor and
that is why she is here.
Mayor Gee thanked Ms. Baldini for her personal accomplishment and thanked her
for the information. He said she would be hearing from the City Manager.
Tania Sole spoke about the process around the Inner Harbor meetings and
schedule. She would like to have things slow down so there is time to communicate
with the community.
Lee Callister spoke about Docktown and he said that the State Lands Commission
now says that houseboats are not permitted in that area. He says the question is
how to respond to that assessment. He believes that the taskforce and most of the
meetings held show that public community supports a floating community. He
provided information on how this community protects the creek and champions
public use. He believes their presence adds to the public enjoyment. He
commented on the leases and how the City and t residents have worked very hard
to reach an agreement. He requested that the City take legislative action.
Mayor Gee said that the Council has received the letter from the State Lands
Commission as well as Mr. Callister's letter, and staff is reviewing both documents.
James Jonas spoke about the State of California asserting that as the shoreline
moves so does the jurisdiction area under the State of California. With this
movement a lot of uses are disallowed. He referred to the public trust doctrine and
how State Land defines itself, and while he believes there is a common challenge
there is also a common opportunity with this law. He sees an opportunity to
challenge the State on this front and fix the issue for the shoreline of Redwood City.
Alison Madden spoke about one paragraph of the lease agreement, and how
Contract Law allows for the American rule with only two exceptions. She specified
what these are and provided examples. She requested a change to the agreement
to not make it applicable to fundamental policy defenses related to public trust.
She believes the State Lands Commission did not make a ruling on this but the
letter reflects staffs position.Ms. Madden said that no public hearing had been held
on this matter. . She believes the authority on the State Lands Commission letter is
very thin and she asked Council to make the distinction on the lease agreement to
carve out public trust issues
CITY COUNCIL March 10, 2014
MEETING MINUTES PAGE 3
MINUTE BOOK NO. 65
Page No. 94
