agreement shall be returned to City. Title to property purchased <br /> with funds under this agreement shall belong to City and such <br /> property shall be returned to City at termination of this <br /> agreement. <br /> 2. It is expressly understood that this agreement is funded <br /> entirely by a grant from U.S . Department of Labor, Employment and <br /> Training Administration, for a PSE program and that the program <br /> and this agreement shall only be in existence and valid as long <br /> as such an approved grant is available to support the program. In <br /> the event such funds become unavailable for any reason, this <br /> agreement shall become null and void and City shall incur no <br /> obligation hereunder. <br /> 3 . Funds to support this agreement shall be paid to Employing <br /> Agency upon a reimbursement basis as invoiced periodically by <br /> Employing Agency in a manner instructed by City. City reserves <br /> the right to withhold a sufficient sum of funds from the invoice <br /> request in the event that any invoice is not consistent with <br /> Employing Agency 's approved budget and work statement attached <br /> hereto, or shows unallowable costs. Upon satisfactory resolution <br /> of such inconsistency, City will release the approved sum of funds <br /> at its earliest possible opportunity, not to exceed ten working <br /> days. <br /> 4 . In performing the services hereinabove set forth, Employing <br /> Agency shall comply with the applicable requirements of the Act <br /> and regulations and policies promulgated thereunder. The most <br /> important of these regulations and policies will be set forth <br /> explicitly in the program instructions developed by the City. <br /> 5 . It is expressly understood between the parties hereto <br /> that City has general policy control over the management and <br /> -4- <br />
