The Proposer shall also email a pdf version of their Proposal to: kmees@redwoodcity.org or include a CD containing the pdf version with their sealed Proposal. 3.4. Withdrawal of Proposals A Proposer may withdraw its Proposal at any time before the RFP submittal deadline by delivering a written request for withdrawal signed by, or on behalf of, the Proposer. 3.5. Rights of the City of Redwood City This RFP does not commit the City to enter into a contract, nor does it obligate the City to pay for any costs incurred in preparation and submission of Proposals or in anticipation of a contract. The City reserves the right to: • Make the selection based on its sole discretion; • Reject any and all Proposals; • Issue subsequent Request for Proposals; • Postpone contract start date or construction phase for its own convenience; • Remedy technical errors in the RFP process; • Approve or disapprove the use of particular sub-consultants; • Negotiate with any, all or none of the Proposers; • Accept other than the lowest offer; • Cancel the RFP and reject any and all quotations in whole or in part when it is in the best interest of the City; • Waive informalities and irregularities in the Proposals; • Enter into an agreement with another Proposer in the event the originally selected Proposer defaults or fails to execute an agreement with the City; • Enter into an agreement with a Proposer or multiple Proposers’ for portions of work as outlined in Attachment A (Scope of Work). • Reject proposal or stop-work after award due to changes in Project Manager, Assistant Project Manager or contractor/subcontractor staff until acceptable solution is provided. • An agreement shall not be binding or valid with the City unless and until it is executed by authorized representatives of the City and of the Proposer. 7.1.D. - Page 15
