<br />RFP Pan Am Barge Removal – due 20 June 2014 Page 4 of 22 <br /> <br />The use of double sided paper is encouraged. <br /> <br />The Proposer shall also email a pdf version of their Proposal to: <br />kmees@redwoodcity.org or include a CD containing the pdf version with their sealed <br />Proposal. <br /> <br />3.4. Withdrawal of Proposals <br />A Proposer may withdraw its Proposal at any time before the RFP submittal deadline <br />by delivering a written request for withdrawal signed by, or on behalf of, the <br />Proposer. <br /> <br />3.5. Rights of the City of Redwood City <br />This RFP does not commit the City to enter into a contract, nor does it obligate the <br />City to pay for any costs incurred in preparation and submission of Proposals or in <br />anticipation of a contract. The City reserves the right to: <br /> <br />• Make the selection based on its sole discretion; <br />• Reject any and all Proposals; <br />• Issue subsequent Request for Proposals; <br />• Postpone contract start date or construction phase for its own convenience; <br />• Remedy technical errors in the RFP process; <br />• Approve or disapprove the use of particular sub-consultants; <br />• Negotiate with any, all or none of the Proposers; <br />• Accept other than the lowest offer; <br />• Cancel the RFP and reject any and all quotations in whole or in part when it is <br />in the best interest of the City; <br />• Waive informalities and irregularities in the Proposals; <br />• Enter into an agreement with another Proposer in the event the originally <br />selected Proposer defaults or fails to execute an agreement with the City; <br />• Enter into an agreement with a Proposer or multiple Proposers’ for portions <br />of work as outlined in Attachment A (Scope of Work). <br />• Reject proposal or stop-work after award due to changes in Project Manager, <br />Assistant Project Manager or contractor/subcontractor staff until acceptable <br />solution is provided. <br />• <br />An agreement shall not be binding or valid with the City unless and until it is <br />executed by authorized representatives of the City and of the Proposer. <br /> <br />7.1.D. - Page 15
