Include similar <br />information for any projected subcontractor. <br /> <br />This section should also include a Profile of Lawsuit, Litigation, Injury, or Fatality: <br />• List any lawsuit or litigation and result of that action that is still pending or <br />has occurred within the last five (5) years. <br />• List all projects where claims or settlements were paid by the firm or its <br />insurer’s within the last five (5) years. <br />• List all work related injuries or fatalities in the last five (5) years. <br /> <br />5.3. Qualifications of the Firm and all subcontractors. <br />Describe the Proposer’s and sub-Proposer’s qualifications and previous experience <br />on similar or related projects. Provide descriptions of pertinent project experience <br />with other public municipalities and private sector clients in the last two (2) years. <br />This includes a summary of the work performed, the total project cost, the <br />percentage of work the firm was responsible for, the period over which the work <br />was completed, and the name, title, phone number of clients to be contacted for <br />references. <br /> <br />5.4. Proposal Cost <br />This is a turn-key project. Unless otherwise specified, all costs for fees, permits, <br />materials and subcontractors required to perform the entire project will be included <br />in the Proposal. <br /> <br />5.5. Safety <br />Proposal must thoroughly address Proposers commitment to personal, property and <br />environmental safety. Successful Proposer will submit Safety Plan, specific to this <br />project not later than fourteen (14) days after award. Safety Plan must be approved <br />by the City before actual work commences. <br /> <br />6. Contract Type and Method of Payment <br />It is anticipated that the contract resulting from this RFP, if awarded, will be in the form <br />attached to this RFP as Attachment C and will be a lump sum agreement with payments based <br />on 100% of the work completed, accepted by the City and unconditional lien release(s) <br />provided by all contractors and subcontractors.. No mobilization or phased payments will be <br />considered. <br /> <br />Payment to the successful Proposer shall be made upon successful and satisfactory completion <br />of all work as outlined in Attachment A (Scope of Work) with a total fee as set by the Proposer <br />in the Proposal or as negotiated between the Proposer and the City as being the maximum cost <br />to perform all work. Unless otherwise expressly indicated in writing by the City, this figure shall <br />include all direct costs and overhead, such as, but not limited to, insurance, equipment, <br />7.1.D. - Page 17
