Hear public comment; <br /> Don Bryant, Attorney with San Mateo County Legal Aid Society, stated he was <br /> present on behalf of the former tenants of 309 Heller Street, and asked Council to begin <br /> the process for relocation payments. Mr. Bryant stated that the tenants moved because <br /> of the City's notifications to the owner, and suggested that if the City did not have <br /> relocation guidelines in place, that Council and staff treat this matter as a special <br /> circumstance for which there is a precedent. <br /> In response to Council questions regarding the relocation procedures and process, City <br /> Attorney Schricker advised that Section 42 of the City Code provides the <br /> authorization for relocation and it is in effect. Mr. Schricker advised that the policy is <br /> in place; however, it has not been implemented. If there is a constructive eviction and <br /> if the former tenants are entitled to relocation assistance, the owners of the premises <br /> would be liable for those payments. <br /> Mayor Gasparini reminded everyone that this was an abatement hearing, and <br /> discussion of relocation policies was not on the agenda and could not be discussed <br /> according to the Brown Act. Mayor Gasparini asked staff to provide more information <br />~ on relocation assistance procedures. <br /> MEMO 1/17/95 <br /> Vice Mayor Hartnett advised that the relocation ordinance was in place and asked <br /> staff to move expeditiously in this matter. Vice Mayor Hartnett requested staff to <br /> prepare a report showing I) where the City is in the relocation process, and in <br /> particular, this situation; and 2) a report on the process, in general, for future use. <br /> MEMO 1/17/95 <br /> Housing Coordinator Jones-Thomas advised that City Ordinance 2048 provided for <br /> relocation payments, but implementing guidelines had not been adopted by Council. <br /> Mrs. Jones-Thomas advised that the Council could either adopt specific interim <br /> guidelines for this tenant, or adopt implementing guidelines for the City's relocation <br /> assistance program. <br /> In answer to Council questions regarding language in the abatement notice, City <br /> Attorney Schricker advised that "we purposefully use generic language or very <br /> general language because the work must be carried out by the owner and we don't want <br /> to specify specifically the manner in which the work should be carried out....we set the <br /> standards according to the Codes, Health Codes and regulations, and so forth."
