Commissioner Rollins suggested that , following review of the record , <br /> Mrs . Sewell should be so informed . <br /> The Open Space Committee will be comprised of Commissioners Pound , <br /> Aldrich , and Wilson . Commissioner Weintraub was appointed by the <br /> Chairman to fill the vacancy created when Mr . Wilson moved from <br /> the city . Commissioner Aldrich will act as chairman . <br /> Chairman Knecht opened discussion as to the election of officers of <br /> the Commission . It was decided to hold the election at the close of <br /> the agenda . <br /> AGENDA ITEM 1 . Appeal of Mr . Frank F . Giannini , re : removal of Oak <br /> tree from his property <br /> Mr . Weeks reported that Mr . Giannini had requested permission from the <br /> Park Superintendent to remove a large oak tree in his yard . This oak <br /> tree was of sufficient size that it fell under the jurisdiction of the <br /> Tree Preservation Ordinance and would , therefore , qualify as a heritage <br /> tree . It was reported that Mr . Balzarini inspected the tree and under <br /> the terms and conditions of the Tree Preservation Ordinance , was unable <br /> to grant permission to Mr . Giannini to remove the tree . Mr . Giannini <br /> requested permission to appeal to the Park and Recreation Commission <br /> and he was requested to appear at the Commission ' s meeting of June 9 , <br /> 1976 . <br /> Mr . Giannini indicated that when Mr . Balzarini inspected the tree , he <br /> recommended that the large oak tree be trimmed and cabled but not <br /> removed . It was Mr . Giannini ' s opinion that trimming the tree might <br /> kill it and in that he is going to develop the property , he felt the <br /> tree should be removed . Mr . Balzarini indicated that with proper trim- <br /> ming the tree could be preserved and that it did not appear to be in <br /> any state of decline or dangerous condition . The tree was leaning <br /> somewhat , however , it was felt that this was a natural growth of the <br /> tree and did not at present constitute any hazard . <br /> It was pointed out that the tree is approximately 275 years old and if <br /> properly cared for would last for many years . Mr . Giannini asked whether <br /> the City might wish to assume responsibility for the tree and it was <br /> pointed out to him and to the Commission that the Tree Preservation <br /> Ordinance holds the owner responsible and , therefore , the City would <br /> not accept responsibility for the tree . <br /> Commissioner Rollins said , from his observation , it is a beautiful tree <br /> which would enhance any building which might be erected at the site . <br /> Commissioner Aldrich said she had seen the tree and concurs with the <br /> position expressed by the staff . It was pointed out that the staff <br /> offered to assist Mr . Giannini in advising the proper method of trim- <br /> ming and protecting the tree . <br /> -2 - <br />
