• <br /> Mr . Weeks stated that the Tree Preservation Ordinance provides that <br /> every effort within reason should be made to influence developers to <br /> protect heritage trees and that the ordinance provides various condi - <br /> tions which must be met in order to remove the tree . The ordinance <br /> also requires owners to obtain pruning permits from the Parks and <br /> Recreation Department prior to work commencing on any tree being pre- <br /> served under the Tree Preservation Ordinance . <br /> Commissioner Weintraub stated that it was her understanding that pro - <br /> perty values increase when a tree of this stature is growing upon the <br /> property and Commissioner Rollins confirmed that $ 1 , 000 to $1 , 500 <br /> increase in value is what a developer often considers for a tree <br /> of this kind . Mr . Giannini inquired as to whether or not he would <br /> be liable for any damages which might occur caused by the tree once <br /> he had sold the property . Commissioner Rollins responded that Mr . <br /> Giannini would not be held liable . <br /> Mr . Weeks indicated that the appropriate time to re-evaluate the status <br /> of the tree would be if and when Mr . Giannini develops the property and <br /> if it were determined that the tree interfered with the development . <br /> This evaluation would be accomplished as a part of the normal property <br /> development and building permit process at which time the Department <br /> would be involved in the review of the development . <br /> At the conclusion of the discussion , Commissioner Aldrich moved , seconded <br /> by Commissioner Rollins that the Commission concur with the recommenda - <br /> tions of the staff that the tree be properly pruned and preserved and <br /> that the request for removal be denied . The motion carried unanimously <br /> by voice vote . <br /> The Commission thanked Mr . Giannini for appearing before the Commission <br /> and assured him that they have all given his request careful thought . <br /> AGENDA ITEM 2 . Discussion - Items for Joint Council -Commission Meeting <br /> in July <br /> Mr . Weeks said that , upon talking with the City Clerk regarding a joint <br /> meeting with the City Council in July , the Council has suggested the <br /> meeting might be held on Monday , July 26 . <br /> MOTION : Commissioner Rollins made the motion , seconded by <br /> Commissioner Aldrich , that the Joint Council - <br /> Commission meeting be held on July 26 at 4 : 00 p . m . , <br /> at the Community Activities Building . The motion <br /> unanimously carried by voice vote . <br /> -3- <br />
