7.1.B - Page 109 <br /> Lot . The term "Owner" shall also mean a contract purchaser <br /> (vendee) under an installment land contract but shall <br /> exclude any person having an interest in a Lot merely as <br /> security for performance of an obligation. <br /> 1 . 08 Sanitary Sewer Facilities : The term "Sanitary <br /> Sewer Facilities" shall mean the sanitary sewer pipeline <br /> and related facilities, except for the manhole at STA 9+98 <br /> as shown on the Map. The lateral connection from each Lot <br /> to the sanitary sewer pipeline is the responsibility of the <br /> Lot Owner. <br /> ARTICLE II <br /> Maintenance and Improvements <br /> 2 . 01 The costs and expenses of maintaining Rossi Lane, <br /> the Drainage Facilities and the Sanitary Sewer Facilities <br /> shall be paid equally by the Owners . <br /> 2 . 02 Said costs and expenses shall include all repairs <br /> and maintenance reasonably necessary to maintain Rossi <br /> Lane, the Drainage Facilities and the Sanitary Sewer <br /> Facilities in a good, safe and clean condition and in <br /> compliance with governmental authority with jurisdiction <br /> over the Property. <br /> 2 . 03 The Owners shall not undertake any repairs or <br /> maintenance or incur any costs or expenses in connection <br /> with such repairs or maintenance without the consent of at <br /> least four Owners, which consent shall not be unreasonably <br /> withheld. <br /> 2 . 04 The Owners shall share equally the liability for <br /> any personal injury or property damage to any third party <br /> resulting from or arising out of the maintenance or repair <br /> of Rossi Lane, the Drainage Facilities and the Sanitary <br /> Sewer Facilities . <br /> 2 . 05 To the extent commercially available, each Owner <br /> shall keep in force a policy of One Million Dollars <br /> ($1, 000, 000 . 00) single limit bodily injury and property <br /> damage insurance insuring the Owner against any liability <br /> arising out of the use, repair, maintenance or improvement <br /> of Rossi Lane, the Drainage Facilities or the Sanitary <br /> Sewer Facilities . <br /> Grove-Declaration of CCR-Rossi Lane CL4 3 <br />
