<br />The appraisal study and formal report are intended to serve as an acquisition appraisal <br />and will be prepared in a narrative format that is consistent with applicable federal <br />and/or state specifications for narrative appraisal reports. The preparation of a court <br />trial appraisal report in support of litigation necessary to acquire the easement rights is <br />not included in this scope of services, <br />Acquisition Scope of Services and Procedures <br />In order to negotiate with the property owner for the acquisition of the required <br />easement area, OPC will: <br />1. Prepare the offer letter and summary statement, in accordance with state or <br /> federal regulations and approval of legal counsel. <br />2. Personally negotiate with the property owners (or their appointed <br /> representatives) for the purchase of the required easement rights. <br />3. Upon the initiation of negotiations, transmit receipted offer letters to the City as <br /> soon as possible. In instances where the property owner declines to receipt for <br /> the offer to purchase, forward a certification of presentation to the City. <br /> Personal negotiations will continue with the property owners until every <br /> reasonable effort has been expended and it appears that the only remaining <br /> method of acquisition is through eminent domain proceedings when required. <br />4. Prepare all acquisition agreements, deeds, and other documents necessary to <br /> complete the acquisition, <br />5. At such time that negotiations appear to be unsuccessful and eminent domain <br /> proceedings are commenced, provide assistance necessary to aid the City's <br /> condemnation counsel. Negotiations will continue after the filing of a <br /> condemnation action if it is the desire of legal counsel. <br />6. A diary of all pertinent information and contacts concerning the project parcels <br /> will be maintained. <br />7. A written summary of the status of the acquisition of each parcel will be provided <br /> on a monthly basis. It is our normal procedure to discuss the acquisition with the <br /> staff on a more frequent basis, so the City will be kept well informed as the <br /> acquisition process proceeds. <br />8. Transmit all executed documents on successfully negotiated parcels to the City <br /> for acceptance, <br /> Page 3 of7 <br />
