63 <br /> observing that Mr. Cagney has offered his assistance to <br /> the City wherever it may be helpful. <br /> Public Hearing <br /> Proposed amendment to the Zoning Ordinance <br /> relating to family care homes in residential <br /> districts, definition of family, size of <br /> parking spaces fences and walls, and <br /> swimming pools <br /> Assistant City Manager Smith called attention to the re- <br /> ports received by Council with regard to the subject <br /> amendment and advised that Planning Director Schroeter <br /> is present to reply to questions . <br /> Mayor Weymouth declared open at 7 :37 p.m. the subject <br /> public hearing. <br /> City Clerk Hildebrand reported the Affidavit of Publica- <br /> tion of Notice of Hearing is on file in her office and <br /> that no written communications have been received . <br /> In response to question, Planning Director Schroeter ad- <br /> vised that the various parts of the proposed amendment <br /> were considered by the Planning Commission at different <br /> times, but are being presented together to Council at <br /> this time. Mr. Schroeter also advised that the 76-inch <br /> fence height limit mentioned was already in the Zoning <br /> Ordinance and does not represent any change, although <br /> the height maximum for rear yard fences has been increased <br /> to 7 feet. He acknowledged that it is a peculiar height <br /> limit, noting that building materials are usually in six <br /> foot lengths, and he observed that a fence -may be con- <br /> structed at any height less than 76 inches, in any case. <br /> Discussion followed and Mr. Schroeter replied to questions <br /> and commented regarding the determination of measurement <br /> of sound from pool equipment and the proposed change that <br /> location of such equipment be determined on the basis of <br /> the sound generated by it rather than upon a setback re- <br /> quirement. In response to request, Mr. Schroeter agreed <br /> in the future to provide information concerning previous <br /> requirements so that proposed changes would be more <br /> apparent. <br /> Mayor Weymouth invited anyone present in the audience who <br /> wished to speak to do so. No one present wished to speak. <br /> MOTION: Councilman Henderson moved, seconded by Council- <br /> man Williams to close the public hearing. <br /> The motion carried unanimously by voice vote. <br /> The public hearing was closed at 7 :48 p.m. <br /> MOTION: Title having been read, Councilman Henderson in- <br /> troduced the following ordinance and moved, seconded by <br /> Councilman Norris, its approval for first reading : <br /> -2- <br /> Reg.Mtg. <br /> 7/7/75 <br />
