291 <br /> MOTION: Councilman Barrett moved, seconded by Council- <br /> man Rhodes, that if a particular agency provides for <br /> reimbursement of out-of-pocket expenses to a Redwood <br /> City Councilman who is a City representative on such <br /> agency, then the Councilman shall not submit a claim <br /> against the City for such expenses. <br /> ""." The motion carried unanimously by voice vote. <br /> (MINUTE ORDER NO. 75-344) <br /> Appeal of denial of variance re <br /> garage construction, 248 Hudson Street <br /> (Mr. and Mrs. Primo Garofani) <br /> Planning Director Schroeter referred to Planning Com- <br /> mission minutes of January 21, 1975, described the <br /> requested variance and the considerations of the Plan- <br /> ning Commission in denying the request of the subject <br /> applicants. Mr. Schroeter also reported the challenge <br /> by the Building Department to the applicants' statement <br /> that they were advised orally in 1971 that the garage <br /> might be constructed some 2-22 feet from the side of <br /> the property, observing that the first record of in- <br /> quiry that department has from the applicants occurred <br /> in February 1974. At that time, the Building Depart- <br /> ment representative was in the area on other business <br /> and saw the garage foundation which had been constructed, <br /> although the applicant had not applied for the necessary <br /> • -- permit. Mr. Schroeter requested the information be in- <br /> cluded in the record. <br /> In response to question, Mr. Schroeter reviewed the <br /> general reasons for zoning regulations and the setback <br /> requirements. <br /> Discussion followed and Mr. Schroeter replied to ques- <br /> tion concerning the neighborhood in question and the <br /> fact that the garages on most properties are constructed <br /> in the same location in which the applicants wish to <br /> construct theirs, noting that standards have changed <br /> with regard to setbacks and that the area is an older <br /> part of the City. <br /> Mayor Weymouth invited Mr. Primo Garofani, the applicant, <br /> to comment. Mr. Garofani replied that his statements <br /> were included in his letter of appeal and he had no <br /> further remarks to make. <br /> MOTION: Councilman Henderson moved, seconded by Council- <br /> man Norris, to uphold the recommendation of the Planning <br /> Commission and deny the application for a variance to <br /> construct a garage at 248 Hudson Street. <br /> "'m* Upon advice of City Attorney Schricker on learning that <br /> Mrs. Garofani had a limited English vocabulary, Mayor <br /> w++ Weymouth asked Mr. Garofani if he understood the pro- <br /> ceedings with regard to his application for a variance. <br /> Mr. Garofani replied that he did. <br /> -4- <br /> Reg.Mtg. <br /> 2/10/75 <br />
