Mr. Warren asked for approval of <br /> the tank plans in order that the developer may proceed <br /> with construction. <br /> lbw <br /> Discussion followed and Mr. Warren, Mr. Fales and City <br /> Attorney Schricker commented and replied to questions <br /> concerning the desirability of delaying bidding on the <br /> landscaping of the project; possible cost savings; other <br /> types of water tank designs; the additional maintenance <br /> costs related to a depressed water tank on the particular <br /> site; and the fact that construction of the tank is part <br /> of the previously arranged settlement with Mobil for con- <br /> struction of items up to a total value of $1.8 million <br /> for GID No. 1-64. <br /> In response to question, Director of Public Works Pusich <br /> advised that before final award of bid the Council will <br /> receive an entire accounting concerning the initial <br /> water reservoir, including the bids received for the <br /> tank and the estimated cost of approved landscaping. <br /> MOTION : Councilman Williams moved, seconded by Council- <br /> man Rhodes, to approve plans for the initial water reser- <br /> voir for GID No. 1-64 and notify the developer to proceed <br /> with construction in accordance with prior settlement <br /> agreement and that : (1) the City Council certifies that <br /> the Environmental Impact Report has been completed in <br /> accordance with the California, Environmental Quality Act, <br /> 'o' State guidelines and Resolution No. 6882 ; (2) the City <br /> Council certifies that the EIR has been reviewed and <br /> considered by Council and adopts the findings and re- <br /> sponses of the Planning Commission; and (3) the City <br /> Council directs and authorizes filing of a negative <br /> declaration since the previously approved EIR has been <br /> updated for this project. <br /> Councilman Barrett advised that although he was not a <br /> member of the City Council at the time the subject EIR <br /> was first presented, he has since reviewed and considered <br /> it. City Attorney Schricker advised that his review of <br /> the EIR satisfies the requirement regarding review and <br /> consideration by Council of the EIR and that Councilman <br /> Barrett may vote on the matter. <br /> The motion carried unanimously by voice vote . <br /> (MINUTE ORDER NO. 75-70) <br /> City Manager Fales then reported on the City' s applica- <br /> tion for construction of another water tank which was <br /> filed with the Army Corps of Engineers. Mr. Fales ad <br /> ow vised the application was received today in Washington <br /> by the Corps of Engineers, and Congressman McCloskey ' s <br /> yam,, office is assisting the City with regard to the appli- <br /> cation. <br /> -5- <br /> Reg.Mtg. <br /> 4/7/75 <br />
