(continued) that she is served by the California Division <br /> of Forestry in Belmont for fire service. <br /> Lydia Guzman, 501 Upton, said she is concerned <br /> about a possible tax increase, citing a news- <br /> paper story stating that annexation would <br /> result in .a cost of some $3,000 per property <br /> owner for storm drain improvements to some <br /> properties. It was pointed out that the story <br /> is incorrect, since the three properties with <br /> storm drainage problems are specifically ex- <br /> cluded <br /> from the annexation. Mrs. Guzman was <br /> reminded that the proposed annexation origi- <br /> nated with LAFCO. <br /> City Manager Fales reiterated that LAFCO <br /> initiated the annexation and that the law does <br /> not permit the City to terminate proceedings <br /> unless the protest exceeds 50% written pro- <br /> tests of those eligible to do so. <br /> M/_: Bury/ to recommend to the Local <br /> Agency Formation Commission that they drop the <br /> matter of the proposed annexation of the <br /> Kensington Square property. <br /> City Attorney Schricker advised that the Council <br /> does not have the option to drop the pro- <br /> ceedings, <br /> but must proceed with the annexation <br /> unless the required number of protests are re- <br /> ceived from property owners and registered <br /> voters of the area. Mr. Schricker pointed out <br /> that the percentage of valid protests must be <br /> calculated, but since protests may be filed <br /> until the public hearing is closed, it has not <br /> been possible to do so in advance. <br /> Mark Henry, 418 Upton, suggested that 98% of <br /> the subject property owners oppose the <br /> annexation. <br /> M/S: Leipzig/Bury to continue the public <br /> hearing until April 13, 1981 during which time <br /> protests may continue to be filed with the <br /> City Clerk by property owners and registered <br /> voters of the proposed Kensington Square <br /> annexation who oppose annexation. <br /> Carried unanimously by voice vote. <br /> MINUTE ORDER NO. 81-51 <br /> REPORTS OF BOARDS AND COMMISSIONS REPORTS OF BOARDS AND COMMISSIONS <br /> 2.
