GEOGRAPHICAL JURISDICTION OF PORT <br /> Attention was called to the communication of the City/Port Attorney of <br /> FP" July 2, 1981 relating to the Charter provisions regarding "Port Area". <br /> k Discussion followed and Port Manager Di Pietro, City Manager Fales and <br /> City/Port Attorney Schricker commented and replied to questions <br /> concerning the broad scope of the Charter Port area; the need to be <br /> realistic about the extent of Port jurisdiction with regard to <br /> regulations, etc; the lack of desire of the Port Commission to become <br /> involved in matters unrelated to the Port; the fact that jurisdiction <br /> refers to both geographical area and the exercise of authority in a <br /> defined area; the need for consistent zoning; the definition of Port <br /> authority as to navigable waterways for purposes of ocean going commerce, <br /> yacht harbor, etc.; the Port Area Special Area Plan and the <br /> Williams-Kuebelbeck report definitions of Port area through the concept <br /> of land use; and the fact that regulations adopted by the Port must be <br /> related to maritime commerce. <br /> Discussion continued concerning the possibility of conflict between City <br /> and Port designations of land use; the fact that the City Council <br /> appoints and may remove members of the Port Commission; the need for <br /> cooperation of the Council and the Commission; the fact that a land owner <br /> might have a plan consistent with zoning, but one which the Port does not <br /> want in its area of jurisdiction; the possibility of establishing a joint <br /> committee of Commission and Council members to define, address and solve <br /> problems for which there is a potential for conflict; whether a City <br /> redevelopment plan would have to be reviewed by the Port; the fact that <br /> in 1974 there a was a Waterfront Development Plan and also the first <br /> Williams-Kuebelbeck report on which development has been based; whether <br /> it might be preferable to have just the staff of the Port and the City <br /> develop recommendations for a plan which would meet their jurisdiction <br /> requirements; the necessities of good Port development such as rail <br /> access, access from Dumbarton Bridge, the forthcoming Transportation <br /> Study, etc.; the fact that the major area of focus for a committee would <br /> be regulation of land uses; whether a staff of Council/Port com- <br /> mittee would be preferable; and whether there is any need for a joint <br /> committee at this time. <br /> Jnt.Mtg. <br /> CC/Port <br /> 7/6/81 <br /> u <br /> l <br />
