95
AGENDA (continued) ACTION TAKEN (continued)
PUBLIC HEARINGS (continued) PUBLIC HEARINGS (continued)
Item No. 1 (continued) engineer's report commissioned by the
appellant indicates the cause of the
sidewalk problem may not be chargeable to
the property owner. Mr. Hannig pointed
out that the design and contractors for
the recent (1975) sidewalk work were
under City control. Mr. Hannig suggested
a compromise might be possible with the
City sharing the cost.
Stephanie Turkington, Real Estate Trust
Administrator, Wells Fargo Bank,
repeated the statements of Mr. Hannig and
referred to the civil engineer's report
prepared by Randlett, Foulk & Stock,
Inc., dated April 16, 1981 which provides
the basis for Wells Fargo's appeal of the
charges for sidewalk repairs. In
response to questions, Ms. Turkington
acknowledged that although the report was
received by Wells Fargo on April 20, it
has not been shared or discussed with the
Department of Public Works.
Director of Public Works Addiego said
that he was aware the Bank was going to
have some kind of engineer's report
prepared; it was not offered to him; and
he did not request it. Mr. Addiego said
that the sidewalk treatment of Broadway
done in 1975 involved only removing
concrete, curbs and gutters and replacing
with the decorative tiles, and that the
settlement problem is not related to that
project, but possibly to location of the
creek more than a century ago.
Discussion followed and Mr. Addiego, City
Manager Fales and City Attorney Schricker
commented and replied to questions
concerning the nature of the probable M,
cause of the sidewalk damage, the fact
that the Broadway project involved
surface work and could not be the cause
of present failure; the fact that
property owners are responsible for ?.
sidewalk repairs; the fact that the
sidewalk damage may be related to
complicated factors related to early
creek location; the high cost to
investigate the settlement problem; the
possibility of employing a soils engineer
to do borings of the area; the probable 1
extent of any settlement problem; and the
desirability of having staff review the
engineer's report obtained by Wells Fargo
• and do some research on the subject.
M/S: Chandler/Leipzig to continue the
public hearing open until July 27, 1981
pending staff review and research on the
matter,
Carried unanimously by voice vote.
MINUTE ORDER NO. 81-108
Reg.Mtg.
7/6/81 II
Page 2
