// 5' <br /> PUBLIC HEARINGS (continued) <br /> Items 2.a and 2.b (continued) <br /> recovery developed on the site also to reduce the quantity of refuse WIN <br /> transported to Ox Mountain, and urged Council to approve the subject <br /> application. <br /> Steven Moore, Administrative Coordinator for the Palo Alto Material Recovery <br /> Program, described that City's achievements through curbside recycling, <br /> suggesting such a program can save energy, create jobs, increase public spirit <br /> and save money. Mr. Moore said that the State Solid Waste Management Plan can <br /> offer capital for commencement of a recycling program and recommended approval <br /> of the application with some concessions to be granted by the applicant. <br /> Assistant City Attorney Maloney advised that conditions for the use of the <br /> property proposed to be rezoned cannot be adopted at this time. <br /> Jim Thompson, attorney with Wilhelm, Thompson, Wentholt & Gibbs, representing <br /> the appellant, stated that the notice sent to residents by his firm was not <br /> intended to deceive and he objected to the allegations of Mr. Kelly. Mr. <br /> Thompson suggested the City or a regional agency might address itself to <br /> creating a position relating to establishing a recycling program as part of <br /> government services. Mr. Thompson presented questions about the transfer <br /> station operation including responsibility for enforcing hours of operation, <br /> cleanliness, possible health problems and asked if there is expected to be an <br /> agreement with San Carlos on the matter. Mr. Thompson suggested the <br /> Environmental Impact Report (EIR) does not adequately address the traffic <br /> situation. <br /> (Illness caused Councilman Rhodes to leave the Chambers and <br /> Council recessed from 8:40 to 8:55 p.m.) <br /> Mr. Thompson continued, inquiring as to procedures if the volume of garbage <br /> exceeds the capacity of the station and if Redwood City has considered an ■� <br /> alternative site where trucks could be parked and maintained such as <br /> Ox Mountain. Mr. Thompson suggested adequate answers have not been supplied to <br /> his questions; that conditions for operation of the station should be worked <br /> out with San Carlos; and that the EIR is required to be updated. He <br /> recommended that Council request an updated EIR which could be prepared in <br /> three to four months and at present reverse the decision of the Planning <br /> Commission and deny the application. <br /> In response to questions, Mr. Thompson acknowledged that there may be errors in <br /> the notice his firm sent to residents, stating its purpose was to get attention <br /> for the proposed rezoning, and that he has seen the Use Permit for the transfer <br /> station issued by San Carlos, but does not believe it covers everything. <br /> Mayor Biagi stated for the record that Council is considering only the proposed <br /> rezoning of property adjacent to the transfer station site in San Carlos and <br /> for which that City has already issued a use permit, and asked if Mr. Thompson <br /> or anyone else had represented his client in San Carlos when the application of <br /> BFI for the transfer station was approved. Mr. Thompson replied that he does <br /> not know if his client was present or represented at the hearing. <br /> Bruce Albin, 567 Compass Circle, recalled that the City Council rejected the <br /> application for the transfer station. Mr. Albin suggested the subject property <br /> could be zoned to allow first class commercial development which would produce <br /> more tax revenue than the use proposed by BFI. Mr. Albin urged Council to <br /> reject the application. <br /> Mayor Biagi asked for the record if Mr. Albin had expressed his opinion at the <br /> San Carlos hearing on the application for the transfer station there, and Mr. <br /> Albin replied he had not. <br /> Gus Pappas, 587 Seahorse Lane, read his letter of August 20, 1981 opposing the <br /> subject application (letter is on file). Mr. Pappas suggested that if Council <br /> does not permit the rezoning to allow use of property for parking and truck <br /> maintenance, then BFI will be unable to construct the transfer station, in ■� <br /> spite of their having the use permit to do so. <br /> r..ri <br /> Reg.Mtg. <br /> 8/24/81 <br /> Page 4 <br /> 1/ <br />
