4 3 6 <br /> AGENDA (continued) ACTION TAKEN (continued) <br /> PUBLIC HEARINGS (continued) PUBLIC HEARINGS (continued) Immo <br /> 1 -2 (continued) not been studied; that the Port has the neces- <br /> sary sewer capacity and Piombo expects to ""'' <br /> negotiate a fair price for it; that proposed <br /> parking may not presently meet requirements <br /> but that the final development would be pre- <br /> sented with adequate parking; that the bay <br /> location provides tranquillity in spite of <br /> industrial noise and activity; that he is <br /> unaware the Port Commission might oppose the <br /> project as unsuitable; that the homeowners <br /> association would have the responsibility for <br /> removing accumulated silt and that no cost <br /> estimates have been prepared but the amount <br /> should not be large; that possible problems of <br /> water stagnation and growth of algae would have <br /> to be resolved to satisfy the Water Quality <br /> Control Board; that a number of persons in- <br /> terested in purchasing the homes have <br /> approached Piombo; that the convenience of <br /> schools would be a matter to be considered by <br /> purchasers; and that the matters of parking, <br /> responsibility and cost of dredging silt, <br /> water quality, and acquisition of sewer <br /> capacity are technicalities which can be re- <br /> solved at a later date, if the subject appli- <br /> cations are granted. <br /> Borue O'Brien, representing Piombo Corporation, <br /> referred to the letter of January 7 addressed <br /> to the City Council from Fred Di Pietro, Port <br /> Manager, on behalf of the Port Commission, <br /> stating it contains many inconsistencies. Mr. <br /> O'Brien observed that "Charley Brown's" and <br /> Seaport Village are on deep water; that the <br /> subject property is on water too shallow for tirr1 <br /> deep water requirements; and that the Port <br /> does not have a development program. Mr. <br /> O'Brien said that the development will add to <br /> the water surface and, since the 121 homes will <br /> have berths, will add to the marina facilities. <br /> Mr. Fales noted for the record that "Charley <br /> Brown's Restaurant" was built in the area long <br /> before the Port assumed jurisdiction over the <br /> marina and that the decisions permitting the <br /> development of Seaport Village were made either <br /> before or at the time the Port was considering <br /> its purchase of additional sewer capacity. <br /> City Attorney Schricker advised that the City <br /> and the Port have concurrent jurisdiction in <br /> subject matter, but that the City is the lead <br /> agency with regard to land use and the General <br /> Plan, with the Port to issue building permits. <br /> (Council recessed from 8:22 to 8:35 p.m.) <br /> Jim Walton, Vice President and Land Manager, <br /> Leslie Salt Company, former owner of the sub- <br /> ject property, referred to an aerial photo- <br /> graph and suggested that if existing Port <br /> industry is to dictate future Port development, <br /> there will be no changes within the next ten <br /> years. Mr. Walton said that he had attempted <br /> to sell the property for industrial use and <br /> his lack of success indicates there is no such <br /> market in that location.
