18 5
AGENDA (continued) ACTION TAKEN (continued)
PUBLIC HEARING (continued) PUBLIC HEARING (continuedP
2. (continued) spite of its being fenced separately. Mrs.
Mayer asked that the Permit be changed to deny
permission for gates, observing that a 75'
buffer was established around the fenced
fritilleria and suggesting that no such entry
should be permitted to the buffer zone, thus
discouraging access.
Discussion followed and in response to questions,
Planning Director Schroeter advised that al-
though there may be some access from the public
street, there is nothing to compel homeowners to
open their private open space to the general
public; that the open space is the private
property of the prospective 68 homeowners of the
subdivision; that only the preserved fritilleria
is required to be fenced off from access to the
area; and that the fencing at the back of each
lot is not required but was included in the plan
by the developer as additional fencing.
Mayor Rhodes invited anyone else present who
wished to speak to do so. No one else wished
to speak.
M/S: Biagi/Norris to close the public hearing.
Carried unanimously by voice vote and public
hearing closed at 7:55 p.m.
M/S: Leipzig/Chandler to uphold the decision
of the Zoning Administrator and deny the appeal
of his decision granting Architectural Permit
80-14 relating to landscaping of Woodhill Sub-
division, the following findings having been
made:
1) that additional fencing is not required in
the Planned Development Permit;
2) that the proposed fencing, even without
gates would not effectively bar access;
3) that it was never the intention of Council
to bar all access to the open space area.
him The motion carriedIunanimouslyNby roll call vote.
REPORTS OF BOARDS AND COMMISSIONS REPORTS OF BOARDS AND COMMISSIONS
None None
REPORTS OF CITY MANAGER REPORTS OF CITY MANAGER
3.
