Notwithstanding the <br /> foregoing language of subparagraph 9 ( e ) , Developer has <br /> requested that it be represented on the " committee " of the <br /> parties to the Redwood Shores Development Agreement for the <br /> purpose of participating in decisions affecting the use of <br /> the Facilities Fees payable by Developer hereunder . The <br /> Redwood Shores Development Agreement was executed pursuant <br /> to the aforesaid Ordinance No . 1859 , and the " committee " was <br /> established pursuant to paragraph 8 of said agreement . <br /> Developer understands and acknowledges that such GO <br /> representation by Developer on the aforesaid " committee " <br /> a <br /> would require an amendment to the Redwood Shores Development d <br /> Co <br /> Agreement , and that as of the effective date of this <br /> agreement , Redwood Shores , Inc . , a party thereto , has not <br /> given its consent to such amendment . Therefore , the City <br /> agrees to use its best efforts to effect an amendment to the <br /> Redwood Shores Development Agreement , for the purpose of <br /> allowing Developer to so participate on the " committee " . <br /> ( g ) No Fees for Reimbursement . City hereby agrees <br /> that no part of the fees collected from Developer pursuant <br /> to this agreement shall be used for the purpose of <br /> reimbursing another developer , without the prior written <br /> consent of Developer . <br /> 14 <br />
