FUTURE OFF SITE TRAFFIC IMPROVEMENTS . Developer shall <br /> be required to participate in an assessment district or other <br /> fair share funding mechanism hereinafter established by City to <br /> fund the construction of off- site traffic mitigation improvements <br /> to the Ralston /U . S . 101 interchange , and all other related <br /> improvements required as a result thereof , in the event such <br /> improvements are reasonably deemed necessary by the City pursuant <br /> to the conclusions of the Crain Study , which off- site traffic <br /> impacts may be generated or contributed to by the Project in <br /> excess of those off- site traffic impacts addressed by the <br /> Planning Commission on April 16 , 1985 , in approving Planned GO <br /> CD <br /> Development Permit No . PD- 10307 - 4 (which policy is described in <br /> the minutes of said meeting , reference to which is made for the C <br /> particulars thereof ) . <br /> The City agrees to use its best efforts to seek other <br /> funding sources for said improvements . <br /> 11 . CONDITIONS , TERMS AND RESTRICTIONS . <br /> ( a ) Subsequent discretionary actions by the City <br /> pertaining to the Property , including City- imposed limits on <br /> building construction , shall not prevent development thereof <br /> for the uses and to the density or intensity of zoning and <br /> all subsequent land use entitlement processes of the City , <br /> including but not limited to use permits , variances , site <br /> plan reviews and subdivisions , shall permit the use <br /> encompassed within the Project as set forth in Exhibit " B " . <br /> 15 <br />
