C-3 <br /> 3. PROVISION OF PEG ACCESS EQUIPMENT AND FACILITIES <br /> (a) The PEG Access grants described in this Section shall be utilized by <br /> Grantor, or Grantor's designee, for PEG Access equipment and facilities, which <br /> are defined to include, but not be limited to, data communications terminal and <br /> interFace equipment as well as video equipment used in conjunction with the <br /> Cable System facilities. The PEG Access grants described in this Section may <br /> also be utilized by Grantor, or Grantor's designee, for PEG Access operating <br /> expenses and administrative expenses and, furthermore, Grantor and Grantee <br /> agree that said funds are not Franchise Fees for the purposes of the Cable <br /> Communications Policy Act of 1984, as amended. <br /> (b) Grantee shall provide a grant as indicated in Section 7.1 of this <br /> Agreement to Grantor to support Public, Educational and Governmental Access. <br /> The grant shall be continued throughout the duration of the Franchise, unless <br /> otherwise directed by the Grantor or modified pursuant to the provisions <br /> contained herein. The grant funds may be used for equipment, facilities and <br /> operational support for both one-way video Access services and two-way <br /> interactive Access services, at Grantor's sole discretion. The grant funds shall <br /> be paid to the Grantor on a quarterly basis, concurrent with the Franchise Fee <br /> payment. <br /> (c) Upon the effective date of the renewal of the current Franchise with <br /> the present incumbent Cable Operator, AT&T Broadband, or its successor, and <br /> the commencement of the incumbent Cable System Franchisee's PEG Access <br /> support obligation the Grantee shall match the PEG Access contribution of the <br /> incumbent, on a per Subscriber basis, for the remaining duration of this <br /> Agreement. <br />
