easement, the use, maintenance, repair of adjoining areas or for any other purpose in
<br /> furtherance of City's use of the Property. Notwithstanding the foregoing, City shall extend
<br /> reasonable efforts not to interfere with Permittee's use of the permit area in exercising its rights
<br /> under this paragraph. However, Permittee acknowledges and agrees that should the City wish
<br /> to remove this Permit for any reason, it has the authority and right to do so.
<br /> 4. Waiver of Claims. Permittee waives all claims against the City, its Council,
<br /> officers, boards, commissions, agents, employees and volunteers for any damage to
<br /> Permittee's Property in, upon or about the Property, and for injuries to any employees of
<br /> Permittee, its officers, agents, contactors, or volunteers.
<br /> 5. Hold Harmless: Release. Permittee will hold City, its Council, officers, boards,
<br /> commissions, agents, employees and volunteers exempt and harmless from any damage or
<br /> injury to any person, or property, from any cause of action of any kind arising at any time from
<br /> Permittee's use of City's Property or from the failure of Permittee to keep the Property or Signs
<br /> in good condition and repair, except for City's sole negligence or willful misconduct.
<br /> Permittee's indemnification will include any and all costs, expenses, attorneys fee, and
<br /> liability incurred by City, its council, officers, boards, commissions, agents, employees, and
<br /> volunteers in defending against such claims, whether the same proceed to judgment or not.
<br /> This section will survive the expiration or termination of this Permit.
<br /> 6. Insurance. Permittee shall maintain at all times during which this Permit remains
<br /> in effect, at Permittee's sole cost and expense, commercial general liability and property
<br /> damage insurance, which insurance shall be in the following minimum amounts: $1,000,000 per
<br /> occurrence and $2,000,000 aggregate for bodily injury, personal injury and property damage.
<br /> Concurrently with the execution of this Permit, Permittee will furnish City certificates of
<br /> insurance required hereunder and endorsements.
