43. Pavement Moratorium - Portions of Franklin, Diller, and Wilson Streets have either <br /> recently been reconstructed, or may be reconstructed prior to or as part of this project. <br /> Any streets reconstructed within the past 5 years are subject to a pavement moratorium. <br /> Per Chapter 29 of the City's municipal code, no cuts in the street are allowed within 5 <br /> years of the completion of the pavement project. <br /> A. An exception may be granted by the City Engineer pursuant to the findings <br /> in Chapter 29. If an exception is granted, the permittee would be required to <br /> reconstruct the street completely rebuilding, by removing all the pavement <br /> and aggregate base course material, re-compacting the sub-base and <br /> restoring the base material and then completely re-paving the street, for a <br /> minimum of the full width of all lanes impacted by the cut(s) (outside lane <br /> includes to the curb) and extending the entire length of the recent <br /> reconstruction, or for a length determined by the City Engineer to be sufficient <br /> to restore the street to its new condition, as if it had never been cut, or as <br /> more specifically directed by the City Engineer/designee. <br /> B. For recently renovated streets the City Engineer may allow the permittee to <br /> restore the street to its former condition by resurfacing the street to the same <br /> extent as was performed by the City, except that the asphalt or surface <br /> material installed by the City must first be removed by the permittee to a <br /> depth as directed by the City Engineer. <br /> C. Alternatively, a permittee may choose to pay the Pavement Damage <br /> Restoration Fee established by City Council Resolution, in which event, the <br /> City Engineer shall authorize a repair less than full and complete <br /> reconstruction of the entire newly reconstructed street. <br /> Construction-Related Activities <br /> 44. Hours of Construction—Construction activity is permitted between 7:00 a.m. and 8:00 <br /> p.m. Monday through Friday, except as permitted on weekends by the Building Official, <br /> and shall adhere to the City's Noise Ordinance. If possible, the noisiest construction <br /> activities would be scheduled for daytime hours when the ambient noise levels are <br /> highest. ESDR][BUILDING] <br /> 45. Pre-Meeting for Construction - After City permits are approved, but prior to start of <br /> construction, the applicant shall hold a preconstruction conference with Engineering <br /> staff and other interested parties. The developer shall arrange for the attendance of the <br /> construction manager, contractor, and all subcontractors who are responsible for <br /> grading and erosion and sedimentation protection controls. Construction Material in the Right-of-Way - Construction parking, material storage, <br /> equipment, or other construction-related uses are not allowed within the City right of <br /> way without prior approval from the City Engineer. Prior to encroachment permit <br /> issuance, the applicant shall submit a construction parking management plan, which <br /> shall outline the number of construction workers by phase, phase duration, where <br /> parking will be located for each phase. Construction & Traffic Control Plan — The applicant shall submit a Construction <br /> Traffic Routing and Parking Plan for review and approval prior to the issuance of permits. <br /> The plan shall ensure that adequate emergency access is maintained during <br /> ATTY/RES0.3086/PC RESO 1305 EL CAMINO <br /> REV:05-14-15 VR <br /> Page 11 of 17 <br />
