48 <br />6557.03/12309 <br />and its Owner shall be subject to the right of other Owners or the Association to install, use and maintain <br />such common antennae and facilities. <br /> <br />(b) Each Owner shall have the right to install or use a video or television antenna <br />(including a satellite dish) with a diameter or diagonal measurement of thirty-six (36) inches or less so <br />long as said antenna or satellite dish is not attached to the front of a Condominium Building and is not <br />visible from the street or the Common Area, subject to the following restrictions: <br /> <br />(1) Prior to installation of the antenna, the Owner must give notice and make <br />application for the approval of the Association. <br /> <br />(2) The Owner requesting approval shall demonstrate reasonable provision <br />for the maintenance, repair or replacement of roofs or other building components. <br /> <br />(3) In order to prevent any water intrusion or leakage into the walls or roof <br />of a Condominium Building due to the creation of holes or punctures in connection with the installation <br />of any antenna, satellite dish or other equipment contemplated by this Section 7.7, the Board shall require <br />that any such antenna, satellite dish or other equipment be installed without creating any holes or other <br />punctures in any portion of the exterior of a Condominium Building to the extent feasible. <br />Notwithstanding the foregoing, should the Board approve the installation of any antenna, satellite dish or <br />other equipment with the use of holes or other punctures in the exterior of a Condominium Building, the <br />Board shall require written documentation from the installer of such antenna, satellite dish or other <br />equipment that appropriate measures will be taken to prevent any such water intrusion or leakage. <br /> <br />(4) Installers of a video or television antenna shall be required to indemnify <br />or reimburse the Association and its Members for loss or damage caused by the installation, maintenance <br />or use of a video or television antenna. Any contractors employed to install such antennae or related <br />equipment shall be licensed and insured in accordance with applicable governmental regulations. <br /> <br />(5) Applications for the approval of the installation and use of a video or <br />television antenna under this Section shall be processed in the same manner as an application for <br />construction or alteration, and the issuance of a decision on an application shall not be willfully or <br />unreasonably delayed. All Owners having any antenna, satellite dish or cable equipment shall provide to <br />the Association the Owner’s name, Unit number, installation date and location of such antenna or <br />equipment. <br /> <br />(6) The Board shall, in acting upon requests for approval of a satellite dish or <br />other signal reception or transmission devices, comply with Civil Code Section 4725 and Federal <br />Communications Commission regulations. In any action to enforce compliance under this Section 7.7(b), <br />the prevailing party shall be entitled to reasonable attorneys fees, pursuant to Civil Code Section 4725(d). <br /> <br />(c) Notwithstanding any other provision in this Section 7.7, no antennae, satellite <br />dish or other external wiring or equipment shall be permitted to be affixed or attached in any way to any <br />exterior façade or other exterior portions of the building, and shall not extend above the upper elevation of <br />that Owner’s Unit or Patio area, without the express prior written consent of the Board. No antennae, <br />satellite dish or other external wiring or equipment shall be installed in any portion of the Development <br />without first obtaining all required permits and approvals from the City of Redwood City Planning <br />Department, Department of Building Inspection and all other applicable agencies. <br /> <br />Section 7.8 Power Equipment; Hazardous Materials. No power equipment, hobby shops <br />or car maintenance, other than emergency work, shall be permitted in the Development. Owners shall not <br />7.1.K. - Page 52
