78. ArcheologicaA Resources - In the event that any deposits of prehistoric or historic <br /> archaeological materials are encountered during project construction activities , all work <br /> within an appropriate buffer area shall be stopped and a qualified archaeologist meeting <br /> Federal criteria under 36 CFR 61 shall be contacted to assess the deposit and make <br /> recommendations, possibly including complete avoidance of the resources , in-place <br /> preservation , and/or data recovery. [SDR][PLANNING] <br /> 79. Paleontological Resources - Prior to the issuance of grading or demolition permits, <br /> the Community Development Department, in coordination with a qualified <br /> paleontologist, shall assess the project for the potential to destroy unique <br /> paleontological resources and to determine provisions to protect such resources when <br /> applicable, possibly including complete avoidance of the resources, in-place <br /> preservation , and/or data recovery as detailed in Mitigation 7-1 of the DTPP EIR. <br /> [SDR][PLANNING] <br /> 80. Human Remains — In the event that any human remains are encountered during on- or <br /> off-site improvements associated with the project, all work within an appropriate buffer <br /> area shall be stopped and the County coroner and a qualified archeologist be consulted <br /> to evaluate the remains and make recommendations. If the remains are Native <br /> American , the applicant shall notify the Native American Heritage Commission . <br /> [SDR][PLANN ING] <br /> Downtown Specific Protects <br /> 81 . Downtown Mitigation Measures — The applicant shall implement and comply with all <br /> applicable mitigation measures described in the Environmental Impact Report (EIR) and <br /> Mitigation Monitoring Program ( MMRP) for the Downtown Precise Plan , adopted by the <br /> City Council by Resolution No. 15086 , including mitigations expressly identified in the <br /> Initial Study for this project. [SDR][PLANNING] <br /> 82 . Downtown TDM — Prior to issuing a certificate for building occupancy, the applicant <br /> shall provide a final transportation demand management (TDM) program (acceptable to <br /> the City Engineer) which outlines program elements to be implemented by property <br /> management and by the tenant(s). The program shall include an annual reporting <br /> requirement detailing parking utilization rates, TDM program use, and employee mode <br /> choice, due on December 1st of each year. The reporting requirement will continue until <br /> the project's parking garage reaches an average weekday occupancy of 95% and <br /> thereafter for three years. Whenever the project's average weekday parking occupancy <br /> reaches or exceeds 95% , the property owner will have 3 months to revise and resubmit <br /> their TDM program to the City, outlining how the program will further incentivize a <br /> reduction in vehicle trips to the site. [SDR][ENGINEERING] <br /> 83. Notice of Right — The applicant shall submit a "Notice of Right to Downtown <br /> Operations" to all tenants prior to execution of any lease per Section 2. 2.6 of the DTPP. <br /> [COA][PLANNING] <br /> 84.
