Mayor Hartnett asked the Council to approve the consideration of Item 6.B. "out of order <br /> at this time." The Council agreed. <br /> MEMO 3/27/96 <br /> Appeal of the decision by the Zoning Administrator to deny four variances to construct a <br /> 2,100 square feet house at 3738 Laurel Way. (Brad Whitaker, appellant) (603) <br /> Affidavits of Publication of Public Hearing notice and mailing are on file in the City Clerk <br /> Department. <br /> Mayor Hartnett called upon the appellant, Brad Whitaker. Mayor Hartnett advised that <br /> Mr. Whitaker's attorney, Michael McCracken, had FAXed him earlier in the day with a <br /> request for a 30-day continuance to consider suggested alternatives. Mr. Whitaker agreed <br /> that was the case and asked for the 30-day continuance. <br /> Mayor Hartnett determined that the next available legislative Council meeting after the <br /> requested 30-day continuance would be May 13, 1996. <br /> City Attorney Schricker advised that if the Council approved the continuance, there <br />'-- would be no further notice of the May 13, 1996 rescheduled public hearing on this matter. <br /> MEMO 3/26/95 <br /> MIS: CLAIRE/LA BERGE TO GRANT A 30-DA Y CONTINUANCE OF THE PUBLIC <br /> HEARING TO MAY 13, 1996 TO CONSIDER THE APPEAL OF THE DECISION BY THE <br /> ZONING ADMINISTRATOR TO DENY FOUR VARIANCES TO CONSTRUCT A 2,100 <br /> SQUARE FEET HOUSE AT 3738 LAUREL WAY <br /> CARRIED BY UNANIMOUS VOICE VOTE. <br /> MINUTE ORDER NO. 96-063 <br /> Mayor Hartnett explained that any testimony received at this time would not be <br /> considered part of the official record. He also advised that after the appellants worked with <br /> staff over the next 30 days, the proposals before the Council might be different from those <br /> presented in the current staff report.
