Character - defining <br /> features, such as historic light fixtures, have been identified that should be <br /> preserved and incorporated back into the Fox Theatre to the extent feasible as <br /> part of the construction of the Project (see historian report, Attachment 5). <br /> On April 15, 2015, the HRAC held a study session to provide feedback on the <br /> Project's conceptual plan and preliminary historian report. Applicants revised the <br /> plans and the historian report in response to this feedback. On June 11, 2015, the <br /> HRAC reviewed the Project for conformance with the DTPP's historic resources <br /> preservation standards and guidelines, and adopted Resolution No. 15 -05, <br /> recommending approval of the Project, consistent with the DTPP, and subject to <br /> the standards as required in Sections 2.0.3(A)(3), 2.1.3(G), 2.1.4(A), 2.1.4(D), <br /> 2.7.1(F), and 2.9.1(A) (see Attachment 6). <br /> 3. Planning Commission <br /> Per Section 2.0.3(A)(3)(a) of the DTPP, the Planning Commission has the <br /> approval authority to grant the Downtown Planned Community Permit. However, <br /> since the Project requires the City to convey easements to create a secondary <br /> exit from the City's current underground parking at Jefferson Garage, and convey <br /> title to a portion of City -owned property to allow the Project to be developed, City <br /> Council approval is required. The role of the Planning Commission is to make a <br /> recommendation to the City Council on the Project's compliance with the DTPP <br /> and General Plan and consistency with the DTPP Program EIR in accordance <br /> with CEQA Guidelines. <br /> On June 23, 2015, the Planning Commission held a public hearing to provide an <br /> opportunity for public feedback on the Project and to consider the <br /> recommendations made by the AAC and HRAC. The Planning Commission <br /> unanimously recommended that the City Council approve the Project (Resolution <br /> Nos. 15 -09 and 15 -10), Attachments 1 and 2). <br /> Tentative Parcel Map (Subdivision Ordinance): <br /> The scope of the tentative parcel map includes the following (see also Attachment 3): <br /> 1. Merger of four existing parcels into one, then resubdividing into two parcels: 1) <br /> one parcel for the Project that would include the proposed mixed -use office /retail <br /> building and underground parking (Project Parcel); and 2) one parcel with <br /> adjusted property lines for the Fox Theatre (Fox Theatre Parcel). <br /> 2. Creation of a loading /unloading easement on the Project Parcel that would allow <br /> use of the proposed service bay by the Fox Theatre, which would be on a <br /> separate parcel. <br /> Section 30.23 of the City's Subdivision Ordinance outlines the five required findings for <br /> Tentative Parcel Map approval, and requires the Subdivision Committee to disapprove a <br /> tentative parcel map if any of the following findings can be made: <br />
